Stopped by the police

My fella got stopped 2 nights ago at 2.00am. He was driving one of the back lanes travelling to a neigbouring farm where he has permission. The air rifle wasnt in its case, it was down the side of the front seat, barrel pointing at the floor. The magazine was out and seperate. The police stopped him and took his gun out, with the night vision on infront of the police car lights which he is not that impressed about! The copper said it is illegal to carry the air rifle in this way an it should be at all times in a case in the boot. Is this right?

i would keep my gun in a case to not damage it but i think as long as it is not armed it's alright. i'm not sure wether it's legal or not but i do know it's not a good idea to have your gun out of it's case as pepole do get alarmed naturally when they see a rifle.

no its not the gun with the problem it was the crook looking driver they thought looked suspect lol

 

Lol! the copper shite himself when al got out! he went, 'stay there by the car' and then 'do you have firearms?' then when he got the gun out with the nightvision on al grabbed it and the copper shite himself again!

He normally has it in the case but it was 2.00am and it was a back lane where there are only about 4 farms and he has permission on all of them, was just driving from one where he had been shooting to the next one, just his luck that the police were there!

It should be in a case when it being transported from shoot to shoot. If we wasn't on permission then whether he's pulled or not is at the discretion of the police officer at the scene.

 

He could be in deep shit if they take it further and he needs to seek legal advice from a solicitor, rather than a forum.

the police let him go after he put it in the boot, just wanted to know because we thought it was just a loaded air rifle that wasnt allowed and we didnt see why he was so adimant that it must go in the boot, what if your car has no boot? an air rifle not being in the boot cant be illegal can it? he just said yes sir no sir 3 bags full sir! the best way i think.

Sounds like he was very lucky.

 

Driving around with a gun in the car is asking for aggro. Must be rural constabulary to even begin to understand what he's up to.

 

The law says it's supposed to be covered up in a public place but it's all down to the interpretation of the officer at the scene He's the one who will decide whether to make a big deal about it so it's best to try and keep them sweet and spend more time in the field instead of in a cell.

 

If that particular constabulary are asking him to keep it in a bag, and in the boot of the car, then it's better for everyone to comply with it because they will be looking out for him again.

Aye any firearm, carried in a vehicle on a public highway should be secured, that meaning been in the boot in a case or other secure means the police at the time deem fit, be on the safe side, if its not in use bag it and stick it in the boot.

 

Always keep on the right side of the law for all our sakes peoples :)

Any gun carried in a public place must be in a secure case this includes when in a vehicle. Be aware the police have been told to stop 4x4's, cars covered in mud or any drivers wearing obvious hunting/cammo clothing and search for firearms. They are looking for any excuse to revoke F.A.C/SGC'S if you search other forums on the internet you will see there have been many people stopped recently and not all of them have got off so lucky.

dont take any chances carry them within the law it just aint worth the hassle and better for all in long run..

Thats exactly what happened to my fella, he was in a 4x4 also and the first words were 'got any firearms with you?'

He wont be doing it again! he normally has it in the case on the back seat, its just he was in the middle of nowhere travelling to a neighbouring farm so he 'risked' it, definatey wont be doing it again!

I normally put my rifle on the back seat in the cover or out of it put a couple of jackets on top of it and drive between farm ,and if i get stopped i just say heading home they cant see the gun five minutes later im on my way
