Foxgun Tom 75 Posted January 16, 2009 Report Share Posted January 16, 2009 I'm a bloody prat, The wife's just got a notice to prosecute because I got caught speeding in the wife's car she's been asked too identify the driver because her car been noticed on a speed cam. I've no excuses and I'm not looking for any!! I was doing 84mph on a 70mph stretch of the motorway Anyone been in similar circumstances and what was the result?? If it is, the I'd say take it. My partner got stopped at 94MPH on the M6 a couple of weeks ago and got a £60 and 3 points, I think they should bring back the death penalty in her case!!! Just thought of the obvious answer ............ Does your wife know it wasn't her? If not then perhaps she had been driving a bit fast lately .......... Quote Link to post Share on other sites

Tom Cases where a Summons has been issued, (Your Case) the offence carries between 3 and 6 penalty points and a discretionary ban. The fine, can range up to £1,000 for offences on non–motorways and £2,500 for motorway offences. As it the motorway you COULD face up to 14 days ban plus a fine. 2008 the law changed and become tougher, due to the large amount of deaths on our roads, and drink drivers. The courts have a wide range of discretion. You dont need to worry about Totting up, as you say you have no points. The greater the speed the more risk of getting an instant ban. 14mph over COULD get you a small ban, as you were on the motorway. I think you would be lucky to just receive 3 points and £60 fine. Also under the new Law you COULD receive 6 points straight away, then you have one strike left then a full ban. Quote Link to post Share on other sites
Quasar 1 Posted January 16, 2009 Report Share Posted January 16, 2009 (edited) drag it out mate if its a camera... on the 27th day write in and ask for proof - ie picture. 27th day after that ask for calibration certificate etc 27th day after that letter ask for, oh forgot theres 5 things u can ask for and even if they reply before 6 months ull still only end up with 3points and fine.. if it goes OVER 6 months from date on conviction [bANNED TEXT] you are off the hook, as they have to process it within 6 months. i have gotten away with a couple this way cos of pesky 2 or 3 mph difference. dont forget [bANNED TEXT] you are allowed 10% plus 2 mph which makes it 79, so extra 5 mph cam would have got ya. quote : 14mph over COULD get you a small ban, as you were on the motorway doubt it - not even a small chance. its 96mph or over. or 26mph over the limit. then you COULD. Quasar 1 Posted January 16, 2009 Report Share Posted January 16, 2009 it wont even go to court - stop worrying him if u admit it - simply fill in form £60 3 points. points will not be taken to account for 2 years - stay on licence for 4 - insurance companies wanna know last 5 years but they ignore SP30s unless u have more than 3. Foxgun Tom 75 Posted January 16, 2009 Author Report Share Posted January 16, 2009 Thanks people it seems your all right, looking at 3 points and 60 quid lighter in the wallet there's absolutely no point in arguing or dragging it out, I'll just take the 60 quid of the wife's housekeeping as she's to blame for lending me her car whilst she's using her new broomstick she got at xmas. Tom he would say that he's a copper,but it's up to you in the end.I did hear if you say you and your wife were sharing the driving that day and neither of you are sure who was driving at the time then a without doubt prosocution is hard for them to get.I'd drag it out myself like quaser says then come up with my excuse,going guilty is something i don't do myself they have to prove it.
