Inocent to proven guilty

Alright everyone just sat thinking about the recent avents including rabbiting hare coursing and the old bill there seems to be a lot of lads taking flack from copers that dont know there own law I know of a couple of lads now that have been pulled up accused of hare coursing when they have stated that they have only been after conney they have been told to prove it well my thinking is if you have caught bugger all and you have a lurcher and a lamp and have been spoted lamipng how the hell can you prove what you have been after and even if you have rabbits with you that doesnt prove you wherent trying to coarse hare,fox or deer.just wanted to know peoples feelings on this because now your guilty till proven inocent it seems.

Not all plod know the laws on hunting ,but most of the posts I have read indicate that those pulled up were on land without permission ,so whether they were running rabbits or hares is beside the point really. As to the "guilty ,until proved innocent" theory ,I think where this is most glaringly apparent is under the Badger Act, where the onus appears to be on you to prove you are not guilty. Bottom line if you are on land without permission ,you must expect a tug now and then .Its interesting that the Bill appear to be lumping all coursing people with the term thieves and vandals ,judging by their latest announcements.

I fully agree with you a lot are on land with out permision and lets face there aint many people can say they never been some where they shouldnt of been me included and if you get your color felt its one of thos things no one to blame but your self I understand that but just because you have permision doesnt mean your coursing conney and nowt else so how do you prove it thats what I was getting at. Well theres only one permission that i know of which has hares and the rest are just rabbits and foxes, if i were pulled then i would tell the bill to check the land because i know where all the hares are around me

If you are on land with permission, and are stopped by the plod ,on the roadside for example,have not been seen coursing ,and do not have any hares about you ,the onus is on the police to prove otherwise not you .State clearly what you have been hunting[rabbits],and reiterate that you have permission to do so,a written letter helps ,I keep mine in a wallet in the car,and have had no problems. I sometimes get stopped at night when lamping , usually when the Bill spot my 4x4 and get nosey, a quick show of my permission has allways sorted things.I would not advocate poaching ,but if you are determined to go on land you have no right to be on ,I would suggest you park well away from it,and go back to your car without your catch,picking it up later.I realise some lads "wander " and they see no harm in it ,but when you lose ground you have nurtured for years because of poachers you can develop a different view of things.

about a couple of months ago me and a mate jeppi off hear where out doing abit of lamping we had a poor night and called it a day on are way home we called at tesco petrol station to jet wash my 4x4 and in pulled a bobby t5 came up to us sayed the usual now then lads you been doing abit of rabbiting told them yes they could see lurchers though the windscreen i had had the back windows blacked out ithey asked where we had been told them where the land was who owned the land proved everything even phone number and off they went washed car and set off again i live about 1 mile away got about a cock stride away from my house and blues came on same bobby car checked us out fine and compounded my 4x4 untill they had checked with the land owner that we where telling the trueth that cost me £150 to get my car back they had nothing on us at all they did not even check with the land owner

So the police stopped you questioned you ,then let you go,then the same police came and confiscated your car ,which you had to pay £150 to get returned to you? I'm sorry this doesn't make any sense.On what basis did they confiscate your car ? Did you make a formal complaint out? If not why not?

most of my experience with the law comes from salmon poaching but i believe the basics apply ie.they need to find concrete evidence,hairs from something illegal for instance.The mess thst is the hunting act complicates things but the old night poaching act allowed the police seizure powers etc.A lot of police don't know these laws too well and that includes our local wildlife officer,a real arse.If you were not charged with anything i can't see how you would be liable to pay money to get your car back.

So the police stopped you questioned you ,then let you go,then the same police came and confiscated your car ,which you had to pay £150 to get returned to you? I'm sorry this doesn't make any sense.On what basis did they confiscate your car ? Did you make a formal complaint out? If not why not?

same happened to a local lad around hear spent 4 days in durahm while it was sorted they did not have a thing on him and when police impound a car they usaly get a garage to recover them then you are liable to pay for the impounding and the recovery of the vehicle even if proven inocent.

Are you saying that a lad was arrested , imprisoned for 4 days, and was eventually proven innocent ? If he was imprisoned ,he must have been charged ,what was he charged with?Why would it take 4 days for them to establish his innocence? A simple phone call to the Farmer ,or even a quick visit would have confirmed his innocence. Something does not add up here. And If your car is impounded by the Police and you are released without charge ,you would recover your vehicle automatically without any fee. I feel the whole story has not been presented here.

If you have written permission from the Farmer to take legal quarry ,and are apprehended ,doing just that , and your vehicle is taxed ,mot'd and insured, what more would or could you need?. If you have permission to take rabbits ONLY and you are stopped and found in possession of a deer ,a hare or other game such as pheasants then you have problems , the likely- hood is you will be nicked and, [unless it is with the tacit consent of the Farmer], lose your permission.Them's the Breaks.

May not solve it but goes a long way towards proving your genuine and if you have a few rabbits its going to take a very silly copper to want to prove otherwise.
