There are 2 types of Law:

 

(1) Common Law: Common law rights are property or other legal rights that do not absolutely require formal registration in order to enforce them. Common Law is over a 1000 years old. THIS LAW CANNOT BE CHANGED!

 

(2) Statute law, on the other hand, refers to law that has been created by Parliament in the form of legislation.

This can and has been changed.

Just been to one of my walks wich as been there for donkeys years. It is a public footpath that go's through land that is keepered. Anyway today when i get there ther's been a notice put up saying "protected conservation area keep to footpath dogs to be kept on leads". I was just wondering how the notice stands by law ? i think its just a tattic been used by the keeper to protect is birds. Can you tell me what you think, cheers.

 

 

would it be such a problem to abide by his wishes?

 

his birds are his job, if your dogs chase them all off the land he could well be out of a job?

 

you took the words right out of my mouth, if someone doesnt wish you to do that on there land then dont do it

Just to let all you know, i have had a email back from the footpath dept at the council today

 

"Dear Mr. ****, My enquiries have revealed that the land upon which the sign is situated is not formally designated as a wildlife conservation area. The consensus is that the sign has been erected by the landowner of his own initiative."

 

This proves that the notice was put up under false pretenses, just shows again another landowner who thinks he can has he likes with people, BUT NOT ME HEY !!

there shouldnt be a problem mate, if you dont want to abide by his rules, then go walk somewhere else. As living on a farm, i know what problem can be caused by those f*****g stupid footpaths, including stock being let out, dogs running riot, people having a go at ME for shooting on MY OWN LAND so i dont shoot there pussy little dogs while they are walking. Once, a load of kids were letting the stock on the road on a regular basis (like nce a week) so my dad blocked up the stile as we all got fed up. and chained up the gate. within a couple days, the chain was cut off and stock was back on road, so dad put an extra extra thick chain on, blocked up stile with barb wire etc, and got a mouthful from the council, which had ben informed previously about the kids. So stick to his rules, as its people like him which provide you with sport

If you know the keeper why not just ask him for an answer and not some faceless people with a computer ?

 

If you know the keeper and your dogs are so well behaved, then surely it would not hurt to put your dogs on a lead for a while until you had passed where they need to be on a lead.

 

Do you think the keeper is being unrerasonable to you personally or is his sign aimed at others as well, who maybe don't have the same skills at dog training as you, those sort of people who will see you walking your dogs off lead and think they can do the same, letting their dogs run riot.

if i'd asked him about the sign, do you really think he would give a straight answer, I don't think so !! I went about it through the right way got in contact with the footpath dept, proved, has i already know that the f*****g sign was worthless, so now if anyone see's my dogs of the leads and say anything i can backup my argument IF NEED BE.

If you'd read my post right, you would know my dogs don't chase live stock..........Has for me needing to be shot, I hope thats not threat you little prick !!!! Be carefull

Sorry dont know the answer to the original question :( but as far as I understand ownership of the birds ceases when they leave the release pen becoming free/wildbirds

Gamebirds cease to be 'livestock' when they leave a release pen.

 

Game is owned by the landowner on which it is at any given time.

i never said i would mate, just that it would be a good thing if you were :haha: it doesnt matter what your dogs are like. if he wants you to behave on HIS land, which he has to give up anyway, then obide by his rules. or walk somewhere else.

For the record, I don't think it's an unreasonable request for dogs to be on a lead where stock is present. Best not to imply a legal perspective to a notice that doesn't exist, though. A polite request might get a more positive response.
