borderman45 0 Posted November 11, 2008 Report Share Posted November 11, 2008 I walk my 3 on farmland which the public are allowed to use, the problem is there are deer, hare and rabbit there too, my dobe has been in the local paper for chasing, deer my lurcher has had hares and the border flushes all three, do I run the risk of losing my dogs ? Under The Hunting Act 2004, a police officer can confiscate your dogs, cars, or any "article" they believe may be used to commit the crime. They have to have "reasonable suspicion" meaning that they have to be pretty certain you're up to no good for them to do it. Written permission will not always protect you from this, at least not until your defence team start to wipe the floor with them, in court. The arresting officer's viewpoint will determine what level of hassle you're going to receive. Some of the constables in Cheshire are very knowledgeable on this act and do seek people out with their own form of "racial profiling." I would imagine other hunting hotspots are the same. Other areas haven't got a clue and this is clearly obvious when they start quizzing you about it. The point is to be polite and courteous and let them make themselves look like c**ts in court. I'm sure our covert police officers, here, will agree with me. Privately of course. Not been on here long, so forgive me if it's been said lots before, but is there any Legal proffesionals that know the law inside out who can run rings around these people in court?? Clive Rees.
