FAC amendment ?

Hi,

Licensed with Northumbria Police I recently asked for the restriction to be lifted from

on land deemed suitable by the chief officer of

police for the area where the land is situated and over which the holder has lawful authority to shoot.

to

any land on which you have lawful permission from the landowner and you deem suitable. ( or words to the effect )

 

I have been told that there is no such thing as an open cert ( I know lets not get into this one )

 

This was not my first license and to be honest I never noticed the condition until I went to buy rounds and I spotted it.

Well I was on the phone as you can imagine and the FLO said they agree to the amendment that I requested but I had to send the cert in

and send an accompanying letter .....so I did " a week ago "

 

I now have not had the cert returned as yet and I am a bit concerned about the fact that I need to use my .22 for my business

but what happens if I get the pull from the police.

And since they have agreed to the amendment verbally I am not sure if I can make the decision about land deemed suitable to shoot by ME.

or do I need to abide by the condition on the origional cert until I get the new one through ?

 

Hmmmmm....questions questions questions...

How long does it normally take for an amendment like this ?

I cannot speak for the times of Northumbria Police, but here's what i'd advise.

 

Until you have the new FAC in your hand with the new condition and signed by "in effect" the Chief Constable, your original certificate and conditions apply.

 

If I were you, seen as you do not have your original certificate either Avoid using your rifles.

 

Because.....

 

If you do get pulled, you have nothing to say they are legal and yours on the spot and so will have them at best confiscated, and at worst, you arrested for possible possession of illegal weapons.

 

A verbal confirmation will mean nothing to a beat officer who pulls you. And at the times we normally lamp, there is little staff in departments available to find out of you are legal or not.

 

It really is not worth the hassle of getting your rifles back after confiscation and the hassle of a night in a police station.

 

I hope you get it sorted soon, just had a right ride with my Dept myself.

Thats about my thoughts as well !!!!!!!!!!

 

I think I was hoping for a miracle answer but yea I suppose thats about the bottom line.

 

They did say that all us FAC holders are on Central computer and in the event of a spot check that it would show

that I was a license holder.

But as you say, It might create problems and give me the run around to get confiscated guns back.

I would largely go along with SS here but I hope and trust you kept a copy of your certificate before you sent it off....You do NOT need to carry your certificate and just because you have sent it to the police it doesn't mean you don't have a certificate, it is simply not in your possession.

 

With regards anything they have told you verbally they will do for you certificate...then it's simple...when you get a certificate saying it is done then it is legal..until you have the paperwork forget it!!! :thumbs:

Funny you mention the bit about "kept a copy of your certificate before you sent it off" as it happens I mentioned that to them as well.

I was told it would show the words FAKE across the cert and this was not really a good thing to do and if I did copy it I was to destroy it asap once I

get the amended cert through.

I honestly took it as if they did not want the cert copied ( although this was never directly said to me )

So I did not copy it.

( go on call me a fool, I can handle it....lol )

They are correct..the latest certificates do show the word FAKE across them when you copy it....shows its a REAL one, but the police can obviously check!!! Stick it under the nose of your local plod and I bet at least 9 out of 10 of them won't have a clue what is going on!! :thumbs:

 

But you are totally legal..it is only there to stop it being treated as an original certificate!! It shows all your genuine details!!!

I must admit Deker this is sound advice.

as you say 9 out of 10 plod will not have a clue but this

is the situation I am in with this license amendment at this time.

 

Wouldn't you think the system would be updated so all police patrolling at night / day were made aware of current legislation and by-laws..

 

it seems like we have to educate our FLO to the procedures they have to follow in the event they stop someone in this scenario !!!!!

Yes

I rang the FAO today and they said the cert was there and had just been passed and signed

they said it was ready to be posted out, so I suggested collecting it because I needed to buy ammunition

to carry out my work,

They said that as a rule they do not allow the collection of certificates but on this occasion they would do it as a one off.

 

I appreciated the decision by them and collected the cert tonight and went straight to the gun shop for ammo.

 

So at last I have the conditions lifted

( I did however have to prove my knowledge and experience to the department )

This interview was a quite in depth discussion and proof was required.

I revealed records from my business from 1996 to the present day, this even included all estates / land agents and farms where I have worked.

The decision was not made on the spot they had to decide in my absence and get back to me "which they did".

 

Very good but rather thorough service.

 

Over the moon now. :D
