im confused

i read somewhere a while back that foxes make badger setts dirty so the badgers move out, where would you stand if you dug a sett that you knew foxes had overtaken? i know you aren't allowed to dig into a badger sett but would it then count as a fox sett?

FROM WHAT I CAN GATHER THE LAW STATES OR RECOGNISES A BADGER SETTE AS A HOLE IN THE GROUND WITH A BADGER IN IT.SO ITS BASED ON EVIDENCE OF BADGER ACTIVITY IN THE VICINITY AND OUTSIDE SETTE,EG.BEDDING DUNG PITS ETC.

A REGISTERED SETTE IS DIFFERENT.AS FAR AS IM AWARE NO MATTER WHATS AT HOME EVIDENCE OR NOT ONCE IT BECOMES A REGISTERED SETTE IT REMAINS ILLEGAL TO DISTURB IT.

I KNOW OF PLACES THAT WHERE ONCE THRIVING BADGER SETTES NOW NOTHING MORE THAN RABBIT BURROWS ALL CLOSED IN AND SPOIL AND BEDDING ALL TAKEN AWAY BY A STREAM.NOTHING WRONG CHECKING PLACES LIKE THIS AS LONG AS THEY SHOW NO SIGN OF CURRENT BADGER ACTIVITY.

 

WITH THE BADGER LAWS THE BURDEN OF PROVE IS SHIFTED.SO YOUR NOT INNOCENT UNTIL PROVEN GUILTY BUT GUILTY IF SOMEONE SAYS THEY SEEN YOU ATTEMPT TO DISTURB A SETTE OR TAKE A BADGER FROM IT UNTIL YOU PROVE OTHERWISE. :icon_eek: ALMOST IMPOSSIBLE

SO YOUR SCREWED UNLESS YOU HAVE LEGAL AID OR ARE A MEMBER OF A FIELDSPORTS GROUP WITH INSURANCE.

I have often wondered this!

 

I know of one particular bunch of holes that were caved in years ago by cattle but then excavated by charles and this year there was a litter of cubs there.

 

How do you think this would work then considering that the majority had been re-excavated by charles?

 

Could be worth getting in touch with one of those countryside legal people!

If the location in question was a registered place, would it not stay as that, having probably been there for a long period of time, with the chance of it being occupied by its original inhabitants, even if for just for a short time.
