craftycarper 0 Posted July 14, 2008 Report Share Posted July 14, 2008 Right my eldest son (the arsehole) who has worked about six weeks in total this year has gone and got himself in debt. Athough i warned him about borrowing money...Capital one and continuousley changing his mobile phones with no income coming in he went ahead and did it. Now i have found some letters in his room and it looks as though the debts have now be passed onto a debt recovery agency. So hence the question above, what are my rights when and if they turn up and what are there rights as my son is very rarely here as of late, and basically there is nothing to reposes of his anyhow. Anyone have any experience of dealing with these companies, my attitude would of course be to tell them to go feck themselves but seeing as i am often out working long hours and nightshifts i would lilke to know how i stand in all this, don't really give to hoots about him..... Tallyho 181 Posted July 14, 2008 Report Share Posted July 14, 2008 i think if he is living at home then he has give your address, so if im right then your home will now be black listed and i think they can come to your home to try to recover any thing they can on the debt, i might be wrong, but go to citezens advise , they will let you know where you stand. Kay 3,709 Posted July 14, 2008 Report Share Posted July 14, 2008 It would be better for the lad to sort out a payment plan to clear the debt , also double check he didnt need someone as a guarantee to take out the card as he isnt working so then that person will then be liable to pay the debt if he fails to, my sister in law foolishly acted as a guarantee for a neighbour & got landed with a few grands worth off debt for her trouble Quote Link to post Share on other sites

They may threaten you with getting the police to gain them entry, but ALL THE POLICE CAN DO, IS PREVENT A BREACH OF THE PEACE, say if you're kicking off at them, They can gain entrance to your property through an open door or window, but they cannot force their way in past you, or break a lock, etc. The only bailiffs that can force their way into your home, or gain entry against your will are Customs & Excise. Once you've let them into your house however, they can put levy notices on anything, and come back to take them at a later date. Whatever you do, DON'T let them into your house in the first place. They have no rights at all, although they can gain entry through an open window or unlocked door which is a pain as the back door is open a lot this time of year for the dogs. Once they have entered the property though they can return at a later date and forcibly enter in the presence of police and a locksmith and have to secure the property when they leave.... I would get a beware of the dog sign up that way its clearly marked you have a dog & in my opinion they would have to be pretty stuipd to shin a gate knowing a dogs very possibly on the other side of it. I honestly dont think they will do anything like try & gain access , they may pay your property a a visit at some point , but if you get in first & offer some small weekly payment & make the lad see he has to take responsibility for his actions hopefully it will sort its self out , i know our sons are enough to make you fart blood & i dispare of mine but you dont want it happening again & lord only knows what capital one were playing at allowing him to have the card in the first place Quote Link to post Share on other sites

rob reynolds uk 3 Posted July 14, 2008 Report Share Posted July 14, 2008 if they come to your door ..you must offer them £1 a week they have to take it really as you have offerd them the only money you have and if it does go to court you can then tell the court you did offer them money but they would not take it .most will not take it as its too much trouble to keep coming back for it..and they may right it off ..tell them your lad only rents his bed room and no where else same goes for the police its the only place they can search for goods ect ..cant take what you aint got the only trouble with them is they will put there bit on top about £150 to £250 is the norm its there wages ..sorry to say ..
