hyperthetical question

There is a very pleasant middle aged lady who walks a magnificient looking lurcher near to me........

 

she is not 'into' running dogs or hunting at.................has very little knowledge of them.

 

Ive asked her before how he was bred, and she just said " ooh I havent got a clue lovey........I saw his sad little eyes and had to birng him home'......

 

She got this dog about 6 months a go from a rescue centre in during this time to my knowledge her 'pet' has chopped up about 6 Roe....a sheep, numerous hares and rabbits whilst out walking in local woodland and green areas........ during the day....... completely without intent and by accident

 

One was even dropped on a back road to a local country park....... with 6 whitnesses.

 

Upto now she has evaided any kind of problems with the law. The sheep she paid for... and the deer put down to 'accidents'....... still she laughs it off,.......and calls 'Baccas; a little bugger and gives him a scooby snack........ and doesnt really care.........(or even seems to know) of the potential trouble she could get in.................... and in this case ignorance certainly seems to be bliss.

 

Under the guise a unknowing, ignorant pet owner...she never gets into any bother, and is quite blarzey about her dogs exploits........."oooh he caught another deer last night...the little monkey.....arn't you Baccas"

 

.perhaps her luck will run out one day where upon i could offer to give the dog a good loving home :whistling:

 

One thing is for sure....in my hands........it would be different story in the eyes of the law......... but then again i suppose the question of 'INTENT'................................... could come into it somewhere

excellant reply thankyou,DARCY so you recon if a dog lets say kills a deer fox are badger on a footpath going through a farmers field are even on its masters own land around the field while lazing around and the wild animal came to close for comfort there should be no case to answer???????????????mark

 

 

 

 

I supose its all down to how you portray yourself to the 'powers that be' when you do get collared.....................

 

Like I mentioned the aforementioned lady has not even seen a copper, never mind a bail slip...........................

 

Personally if I was alone with one dog and it killed, and I got collared........................I'd be laying it on marmite :whistling:

if a person was walking his/hers dogs on permision and the dogs happened to come across one of the above completly inicent and killed it what would be the outcome if you were seen and maybe pictures taken,this is not baiting are anything like that a sunday afternoon walk and this happened,no hunting involved are anything......................has there been any cases,mark

Think you might get a little lee way if it was a fox,depending on what the witness was prepared to say.Badgers are ,I beilive , unique in English law,in so far as it seems you are guilty until you can prove otherwise.I think intent would have to be proved if it was a fox or deer ,but a pig,the onus is on you .

On a foot path and you were walking yopur dogs i doubt if the police would push it.......i know someone whos 2 lurchers caught a deer on footpath....it wasnt anyones fault./..after all...accidents do happen and with the amount of badgers around now its just one of those things. as you were as responsable as possible and tried to called/take the dogs off the best you could then i really cannot see how you can be done. after all, there was no intent, just a guy walking his dog....

I suppose as a hunting man,.you don't want to make a regular habit of it though. :thumbs:

 

If you take a few terriers and a running dog or two out into the countryside,.it is inevitable that something will occur..Personaly,.I try to avoid 'accidents',.but,.if I am working in the 'set-a-side' for the rabbits,.prior to ferreting or maybe pushing rabbits out of high grass towards a net,..and,.a hare, fox or deer rises,..well,.that is tough luck...If somebody wishes to make a court case out of it,.then so be it,.. :drink:

 

INTENT,...that is the word... :thumbs:

phil that is a top photo there :clapper: one you can get lost in just looking at it,the main problem with this hyperthetical question is theres a lot of badgers around,and my lurchers have never looked at one :no: i taught them from pups there a no go,but terriers are a differant thing, and when one starts they all start but its only a matter of time till this government has to do somthing every farm i go on down here have problems with them :yes: ,and there is nothing they can do,they dig pits on my garden at night and shit they winde the terriers up at night when they creep around the chickens weres it going to end and how,anyway some good answers on this hyperthetical question when will the courts have to answer my question surely it wont be long :whistling::whistling: there all over the place

if its a fox tell whoever saw you to go do one and mind there own buisness,if it a pig tell them its an escaped raccon that bit a small disabled iranian man and they will take pity and say nowt.if its a deer stand tall and shout...... theses sheep dogs are bloody clever now arnt they !!!!!!!! if in doubt run...... but never mind mark we all know your dogs wunt tackle anything that isnt round red and have first written on it lol lol lol lol lol

i dont mind people hijackin threads with such lovelly photos because there a pleasure to look at :thumbs::thumbs: what if it had caught that hare on the way to the net accidently of coarse what is the punishment?????????? like its been said on here before it depends on how you conduct yourself???????????and phil iam sure you would act the perfect gentlemen and spiderpig well you proberly would serve a sentance :D:D:thumbs: only joking love them pictures though,mark

:laugh: Well,.its most unlikely that my Wife's soft hearted, lap dog would actualy catch a hare,..but,.Dotty's cur is definitly a slightly different kettle of fish,..and one cannot rely on her assistance or understanding of the job in hand... :icon_redface:

So,.she might spin a hare over...but ,..there would still be no INTENT to course and kill the poor unfortunate on our part :angel:

This is always going to be a difficult issue to deal with..

 

However,..I feel confident that if an 'accident' was to occur whilst we were engaged in the re-location of the hares,.OR 'puss' got herself taken out on another occasion,.., whilst following my legitimate employment as a rabbit controller,..I cannot see an English court of law wasting valuable time and money trying to make a case out of such a trivial matter...I may be wrong,...but these things could happen on a daily basis,.so,..I'll risk it.

As for the Badger business...Well,..it does happen,... :yes:

The badger has an amazing degree of legal protection in the UK,...

But I genuinely believe that as long as you have not gone out of your way to hunt the critter down,..well,.feck it,..shit happens,..and will continue to happen... :yes:

now dotty it was a hyperthetical question not relating to anyone in perticuler but the person who so called saw it was a very good freind of the the politican who got the huntig ban through commons a mr foster so we will see what happens its all hyperthetical :whistling::whistling::whistling::whistling:

If you are ever accused you should be very willing to explain the circumstances fully to the police ONCE YOU HAVE SPOKEN TO YOURE BRIEF who will presumably be one of those hunty lawyers(i keep there number on my phone)or any brief is better than non.The main reason for this is that they have to hand over to him all the evidence they have at that time.

Did you read about the bloke who denied even seeing a badger whilst out lamping that night with his child. What he didnt know was that his daughter had video evidence on her phone whilst out lamping to the contrary which of course proved him a liar.Had he spoken to his brief first he would have had that knowledge and been able to explain the accident which im sure it was and also explain his intention to report the matter which im sure he would have had he not been arrested first.
