masmiffy 82
Saw this item on another forum and thought it may well be of interest! Noticed on other web sites that people are having to ask questions on how, what etc the Police use, when testing Airguns for legal limit power. Couple of years back a chap WON his case in the High Court, after the Police had confiscated his airguns, then said they'd not prosecute IF he allowed them to scrap them, at the same time saying that their Firearms/Gunsmith had tested his guns and ALL were over the legal limit of 12ft.lbs. They refused to say what pellet's were used and by whom, so he took them to the High Court. Where he stated that all of his guns were set with one particular pellet type, for each gun. 3 of them were PCP's and 4 were Springers and he had made such a statement to the Police, which was read out in the High Court. Cutting a very, very long story short, mainly 'cos I don't remember all of it, the end result was put on the Law Books as a 'LAND MARK CASE' The Judge stated that he accepted the chaps statement and that the Police were LEGALLY obliged to test the guns ONLY with the pellets that were in the chaps possession and NOT with the heaviest or lightest available. There was a LONG spiele in the eveidence, regarding how Springers performed best with lighter ammo and the PCP's with heavier. Plus the Technical GUFF, ref trajectories etc, etc. In short the chap got ALL of his guns back and the Police HAD to delete the details from his record Quote Link to post

Guest rexdigger
but if you are using a certain brand of pellets and get caught somewhere you shouldnt the gun in your possesion is not over the limit with them pellets then how can they say the guns illegal its like saying all airguns are illegal because they all are capable of over 12ft lbs imo Quote Link to post

Guest bigredbusa
ok gobby , because they tested with supplied valves and not the ones with the gun . once tested they where all over but as they was not the valves that belonged to the guns in question it got thrown out . i wont name drop but he is a well known tuner . woodga 170
so if the guns were not able to hold a charge at the time of seizure and could not fire why were they taken in the first place as no offence had been commited, i know when we used to travel to shoots with a falcon which was well over power the spring and brass hammer were removed in case of a stop and they travelled in another motor ,if the guns cant be made to fire the police cant add parts to make them work to further their own interests or at least they couldn,t Quote Link to post
Guest bigredbusa
tip off and had to act on it . what about if they find an overpowered airrifle with no pellets ? they can still take it to be tested. sorry when i say valves i mean stems (stealth) Quote Link to post

If they find an overpowered WORKING rifle and no pellets it is still overpower. With reasonable cause (and that will mean almost anything) the police can take away any air rifle and test it. A rifle that does NOT work cannot possibly be over 12ft lb! Quote Link to post
Guest bigredbusa
exactly !! but the police still took them. hence why it got laughed out of court . Quote Link to post
