While out yesterday afternoon ferreting with my terriers, I was approached by a group of 5 people out rambling, in a nut shell they gave me some abuse about what I was doing and told me that I was a murdering arshole and should be locked-up. I told them basically to piss off. Well within half hour I had the local police turn up, these "specials" told me to pack-up and I quote " feck-off" or they will charge me with verbal assualt.!!!! I told them I had permission and was doing nothing illegal, and explained that if it was the ramblers who called them all I told them was to piss-off and mind their own business. They of course did not disclose who made the complaint, but waited around until I had collected my ferts and dogs and walked off. In stead of walking to my car which was parked 500 yards away I fecked-off in the opposite direction with these two idiots behind me, after 20 minutes they caught me up and asked where I was going, I explained I was just having a mooch about, and doing nothing wrong. They asked me my name and address, which I did not give them until they told me what I was being questioned for. They told me I HAD to tell them, if I did not I would be done for obstruction. I told them a old address and they informed me that they would be in contact with me and left.

 

Questions :

 

If I have permission, can they come on to the private land and question me.

 

Do I have to give my name and address.

 

Apart from telling the ramblers to piss-off ( and thats all I did, given how hard it is to get permission) what constitutes verbal assualt. ?

I'd ask the land owner to write a letter of complaint to the local nick, or if he doesn't want to write it himself, you write it and get him to sign it.

After all, you were legally controlling the rabbits on his/her land, something that they are lawfully obliged to do under the Pests Act 1954 – Control of Rabbits. It's the law that landowners MUST take steps to control the number of rabbits on there land.

if you had written permission you should have shown this to plod and told him to sod of as this was a legal activity

 

you have to tell them your name and address

My written permission was in the car, I have had permission to work this land for over four years and only once in that time been asked to produce it, and that was by the Game Keeper, I have two written permissions in fact one for pest control and the other to shoot vermin. I know that is the same thing, but the owner wanted it this way.

 

I did not want to walk back to the car, I'm lazy fat git not that I have anything to hide, it's taxed, insurened and road worthy unlike most of the fecking poles and eastern european feckers cars.

 

So in a nut shell, I can be called a murdering small minded b*****d for "murdering" bunnies, and then get a tug from the local old-bill for telling them to piss-off. !!

 

Thanks for your advice, in future I will just keep clear of the usual ramblers paths. it maybe better me thinks.

i used to get to stopped by ramblers on my OWN land whilst setting traps, shooting etc...

 

i know its hard (very hard)...........just politely say hello....and carry on.

 

say nothing else..........i did the same as you mate....launched in verbally, 2 hours later a knock on the door.

 

i guess we have to learn the hard way somtimes.............stay leagal and there feck all they can do.

 

dont rise to it.

 

the police can and will approach you on private land........if they have reason to suspect your up to no good............or if they have had a report saying the same!!

 

getting the landowner to write and complain is a good idea.

No, mate. You get right on with doing what ye legally there for. As, when and where ye see fit. Some toss pots in bobble hats turn up? Keep right on doing what ye doing. They're bound to lose it. Then You phone in and report Them for verbal abuse. Police either come out and deal with it, for you, or they don't come out for any c***. Can't have two sets of rules, can they? And don't forget; One of those 'walking stick' things they gave these days could appear quite threatening to ye, being held by some idiot who's going red in the face as he screams that you're a " murder ". Be sure to mention that concern to the Police too. Threatening Behaviour beats Verbal

Just wondering that if in this day and age of 'the bleedin right to roam' wether it would be worth carrying a copy of the Pest Act with you and waving it under moaners noses and boring them away with a rendition of it! LOL. Anal i know but i guess then at least you would have the Act to back you up.

 

Naive question - do Specials have the same powers that the regulars do then? Didnt know that.

I would of told them to F*#K OFF but surely if you was only getting rabbits unless the land owner makes a trespassing complaint which obviously you had permission so he wasnt going to theres F#*K all the boys in blue could do next time ask them can they be arsed with all the paper work of for an arrest for you just to get a caution or if no one else is about hit with your shovel and run like mad HA HA LOL
