I don't know, it might be tresspassing, as you don't have the right to roam in scotland if you're illegally in pursuit of game, so maybe this comes under it. Criminal damage maybe, so he probably was trespassing. I think that any wild bird which is confined, (ie in a cage) is legally classified as 'livestock'. This also applies to pheasants in a release pen. There is also an offence of 'interfering with a legal activity'. In a recent case against some sabs, they claimed that the activity was not legal as there was no H&S policy in place as required under the H&S regulations 1999, and the case was thrown out of court. Its people like this who make me want to see public flogging brought back.................... Quote Link to post

alimac 882 Posted June 15, 2008 Author Report Share Posted June 15, 2008 well the morning of sat 14th for my statement turned out to be 10 pm on sunday 15th there now away to see the farmer who witnessed the addmittion (10 30pm on a sunday evening) even though i asked them to not bother him so late or go and see the acused first to see if he would admitt it to the police before bringing the farmer into a situation he would rather avoid... but any way they said he (acused)could be charged with "breach of the peace" although im starting to convince myself i may have got my wires crossed with that one.. they said they would call and let me know what was said and what will happen next... Allimac if the boot was on the other foot your freindly anti neighbour would have your arse in a sling in a heartbeat and dont forget it, youve done the right thing let it run its course, at least the prick will no the boundaries of his behaviour. I had my doubts anything would happen, and I have to say that I in all likelihood would have not bothered with it. Will give it serious consideration if the situation arises!
