The presence of the occupier is normally taken to mean within sight and earshot of the individual borrowing the firearm. Rifles 1968 Act Section 16.1 of the Act enables a person to borrow a rifle from the occupier of private premises and to use it on those premises in the presence of either the occupier or their servant without holding a firearm certificate in respect of that rifle. The term "occupier" is not defined in the Firearms Act, nor has a court clarified its meaning. However, the Firearms Consultative Committee in their 5th Annual Report recommended that the provisions of section 27 of the Wildlife and Countryside Act 1981 be adopted. This states that "occupier" in relation to any land, other than the foreshore, includes any person having any right of hunting, shooting, fishing or taking game or fish. ------------------------------------------- As far as I'm aware this is still the position, so if you fulfill ALL the requirements you don't have a problem and therefore the answer to your question is No! njc110381 0 Posted March 20, 2008 Report Share Posted March 20, 2008 You'll get a different answer from everyone on this probably, so here's my opinion. Phone your FEO and ask him. The rules state that you must be accompanied by the landowner or his agent. His agent could be anything from the tennant farmer to someone with written shooting rights from the landowner, depending on how your force interpret the law. I always see the agent as someone with written permission, as they are acting on the instruction of the landowner (that makes the permission holder his agent). Another thing you must be sure of is that your friends permission extends to guests, otherwise you'll be breaking the law by shooting the land without permission. The safest way is to get the info from your local force. That way you have some comeback if you ever need it. Quote Link to post

ATB SA ...you are a little confused there, an OPEN FAC does give you the authority to shoot anywhere you consider appropriate, as long as you have permission! That is the whole point of an open fac, the chief officer of police does NOT have to deem the land suitable! Quote Link to post

That is the whole point of an open fac, the chief officer of police does NOT have to deem the land suitable! correct ! i hope im not hijacking your thread here, but on the same lines about an open & closed ticket & what deker just said... closed licence: my license states that my 22lr rimfire & sound moderator can be used for vermin control on land deemed suitable by the chief officer of police & where i have permission.. open ticket: the holder of the licence can use the said weapon, ect on land he sees fit & so on & so on.. my point been, call up the BASC, or whoever you or your friend have insurance with & talk to the firearms dept & ask their professional advice, thats what there their for. problems with forums, you can ask a question & get a dozen different answers. you dont know whos sitting on the other end of a keyboard.. & sporting agent, an open ticket does allow the holder to shoot where he/she sees fit.
