" actually you can ,i believe its classed as 'theft of fishes' in the daytime and poaching after 1hour after dark. an additional charge of trespass is unlikely as there needs to be 3 or more people entering the property for that, however two further offences are committed and could (though seldom!) be charged with burglary (entering a property as a tresspasser with the intention of committing an offence) and going equipped to commit a crime ie nets, hand-line , hooks ,even a balaclava! If you actually get arrested you will be charged with the offence easiest to prove and get the CPS to take seriously.then you will be bailed (sec 47/3 of PACE) with restrictions not to enter within the curtilidge of the IP (injured person) or contact them. As long as no violence or threats of such have been made during yer ordeal , you don't have a huge amount of fish and haven't been nicked for it within a year or so the CPS wont deem prosecution to be in the interests of justice or the public good,resulting in a caution from an inspector or an acting inspector. yes you are correct but nets come under fixed engins i got 3 months for it but it took them 17 years to get me and they made the most of it the other 2 lads with me were find 100 each british justice theft is theft never mind what it is and as long as there are things to be stolen there will be thiefs thats the way of the world lee im afraid Quote Link to post
whin 463 Posted March 30, 2008 Report Share Posted March 30, 2008 a few ex fishermen freinds lost cars nets fish localy they have confiscated boats when driffting for salmon was rife , ive lost several nets , the charge for migratory fish is more severe than just raimbows , and it all depends whose land it is you get caught on they are severe in some areas up here cheers, takeing raimbows or brownies is no big offence localy and you maybe get a small fine if your unlucky , fishing laws are diffrent in each locality and the judge if he is akeen salmon fisher well he can come heavy with repeat offenders , no guys who were a bit mad getting 6 months and a 5 g fine for repeatidly going to the same places but they are a bit crazy , Quote Link to post

I've been hunting in one shape another all my fairly short life and I was brought up on a local council estate. Basic facts are, you hunt you don't poach. All you are doing is taking from another mans pocket. If he is a rich man and you are a poor man then get off yer backside and make yourself a rich man and stop whinging and taking your own inadequacies out on someone else. I've always found a farmer or land owner who would let me take deer, pigeon and rabbit for the pot. As for birds well well the law is if they are on my land I can have them and tiny though it is pheasants land on it. As far as fish are concerned, £10 at my local fishery and I get four trout. Can't think why I'd want more in a month! The only people who steal are those that hate the fact they aren't man enough or good enough to get it by fair means themselves.
