jultaylor1972 2 Posted February 24, 2008 Report Share Posted February 24, 2008 I got home this morning to find out that my neighbour had gone mad with my partner because of the dogs barking through the night . Now in order to try and explain the situation I'll start off by saying that over recent months there have been stray cats trying to come into our house at night and if my cats are in the garden there's mayhem when they all start fighting This of course leads the dogs to bark. Well, my neighbour - the one who is going mad about the dogs barking encourages all the stray cats by feeding them and letting them stay in her house Now, this barking doesn't last long and always wakes either me or my partner up and we go down - chase the cats and all is well until the stray cats come back. This might happen two or three times a night and it certainly doesn't happen every night. This last week its been very windy and a lot of stuff smashed and blew around the garden and of course the dogs barked. Surely if there's strange noises in the house or garden then its OK for the dogs to bark?? Am I wrong? I could completely understand if the barking was none stop and I would be doing something about it if it was She even shouts 'SHUTUP' out of her door if they are playing in the garden and just generally running around - like dogs do Well, the top and bottom of it is this - she is going to report us for the amount of noise the dogs make all the time! God help us if we had a baby or children playing in the garden Under usual circumstances I would just give her a piece of my mind but she's 84 years old and I dont think shouting back at her is the best way forward. So, if she does report us; How will it be investigated? Will it be investigated Or will I just get a letter threatening an ASBO? Is it wrong for a dog to bark when it hears noises through the night? SNAP SHOT 194 Posted February 24, 2008 Report Share Posted February 24, 2008 Well jul the local council should have noise specilists on there books, and if a complaint is made then it will be invesigated to my knowledge, However the noise would need to be fairly constant for them to issue proceedings, and it may be measured on several occassions, As for the dogs running around the garden if only barking the odd time i see no problem. You will not know when the council would send someone out so if you hear the dogs barking just get them settled down as quick as you can......good luck Quote Link to post Share on other sites

sue 1 Posted February 24, 2008 Report Share Posted February 24, 2008 i once had that problem a couple of years ago ,the local dog warden came round saying there had been complains of my dogs barking,i was worried like hell cos my neighbour wasnt far from pushing up daisys too but he was very nice about it after i explain why they were barking and he said oh dont worry its just her age they moan about everything i havnt had any complains since Quote Link to post Share on other sites

You potentially face a number of problems and the main one is trying to stay on reasonable terms with your neighbour ....... Surely if there's strange noises in the house or garden then its OK for the dogs to bark?? Am I wrong? No... it is not ok for them to bark if this can be judged a nuisance. Will it be investigated Or will I just get a letter threatening an ASBO? It should be investigated...if it was you complaining you would expect it to be investigated. It is most unlikely you will receive a letter threatening anything!! Is it wrong for a dog to bark when it hears noises through the night? Yes ... it is wrong for them to bark if this can be judged a nuisance. I am not sugesting your dogs are a problem, but you are suggesting they are not, your neighbour does not agree with you. The problem in this situation is that both parties tend to get a bit excited, it could well be that someone need to mediate. One of our neighbours used to breed moggies, loads of them and every now and them a non-white person would call and there would be a few less, then it would start again, so you can just imagine the strays. You know what I sent you after Xmas Not nice I know, but I'm afraid that is what I do. At the end off the day the cats are using your garden as a toilet. Simoman 110 Posted February 24, 2008 Report Share Posted February 24, 2008 A difficult one, if she has complained the local authority WILL probably in the first instance send out a standard letter, if the complaints continue then she may be given sound recording equipment to record your dogs barking and this will also have the time/date etc. Tomos right, bark inhibitors do work. My dogs are all kenneled and rarely make a noise and only if they hear someone walk past the boundry, I make a point of keeping the noise down to a minimum as our old neighbours had two dogs thats barked at intervals during the night that woke both us and the kids up, this I do class as a nuisance and although I didn't report them to the council (I went around and explained calmly that is wasn't acceptable) they were amazed it bothered us yet other neighbours weren't as upfront and complained to the council. July, invest in a dogtra bark inhibitor, its annoying that she feeds the local strays but unfortunately there is nothing you can do legally to stop this and you can guarentee that there will be other neighbours who are cheesed off at being woken in the night who haven't said anything......yet. fishfish 17 Posted February 24, 2008 Report Share Posted February 24, 2008 try reporting the stray cats to enviromental health,just say thyre shitting all over the place and RIPPING bins open and thus encouraging RATS,be sure to mention the old dear is encouraging them,encouraging rats too! as for the dogs try anti barking collars.
