Caravan Monster 323 Posted January 21, 2008 Report Share Posted January 21, 2008 I bought a new Weihrauch HW100 kt at the beginning of december. Within a couple of days, I realised that it would loose about 10 bar overnight if stored below room temperature. I returned it several times to the gunshop where I bought it, where the staff seemed to think I was imagining the problem, or couldn' t count, or something. They basically messed me about until Christmas time, when they 'phoned me to come and take my gun away (presumably having done nothing to sort it). In the new year (3rd jan), I finally got them to send it to a gun smith (under their warranty), where it has stayed. When I asked them last week if they would like to hurry along their gunsmith (whoever he might be), they claimed he was waiting for new seals to come from Weihrauch. I suspect the gun has probably not gone anywhere near a gunsmith. I did overhear one of the gunshop staff say 'oh, thats not a Hull cartridge one', which as I understand it, means that Weihrauch will not honour any warranty because the gun has not been officially imported. Ideally, I would like a replacement gun because they don' t seem to be able to fix mine, or my money back. Is this likely to happen, or have I been stitched up? Apart from zeroing it in the yard, I' ve never even used the bloody thing! Do I have consumer rights in this case? Any advice gratefully recieved. Quote Link to post
moxy 617 Posted January 21, 2008 Report Share Posted January 21, 2008 If you bought the gun new then the retailer should have offered you a 28 day money back guarantee, after this period the warranty is then passed on to the manafacturer for usually no less than 12 months. they will only repair or replace your gun under the terms of their warranty. However the fact that they have sold you a gun that is faulty and have not replaced it instead it sounds like they are using the manufacturers warranty terms is not right. contact your local trading standards office and seek advice from them but it sounds like your having your pants pulled down to me Quote Link to post

Coney 3 Posted January 22, 2008 Report Share Posted January 22, 2008 The DTI publish a fact sheet on faulty goods and the Supply of Goods and Services Act 1982. In this document they say that "Whenever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality, if not the person/firm/supplier are in breach of this "legally binding" contract so quote the above and with a bit of luck they will shit themselves and hopefully "get their fingers out" and get your gun back. SteveieP 0 Posted January 22, 2008 Report Share Posted January 22, 2008 I think the legislation is more likely to be the Sale of Goods Act 1979 as amended by the Sale and Supply of Goods to Consumers Regulations 2002. Goods need to be of "satisfactory quality" i.e. fit for purpose & must comply with any description applied to them The phrase "merchantable quality" has gone out the window because anything can be "merchantable" e.g a car that's only fit for scrap is merchantable, if only to a scrap dealer. "Satisfactory quality" also bares connotations in relation to the price paid e.g if you paid £500.00 for a Ford Fiesta you might expect it to be less than new & have a few blemishes, whereas if you bought it new & paid £8000.00 for it, you might expect it to be perfect. If you purchased the article "as new" & it's broken within a couple of weeks , you have the right to reject the goods & demand a replacement or refund. If the kit is a bit older than that you're probably entitled to a repair. Vendor & manufacturer guarantees & warranties are additional to your statutory rights. If the gun doesn't work as it should then it does not comply with it's description & is caught by the act (unless it was a fault brought to your attention at the time of purchase & presumably reflected in the price) Advice; Go get 'em! Disclaimer: Other do-gooding know-alls are available, the price of units can go up or down & you may loose your home if you do not keep up repayments etc. Quote Link to post
Caravan Monster 323 Posted January 26, 2008 Author Report Share Posted January 26, 2008 Thanks for taking the time to give such comprehensive advice everyone. I got the HW100 back today. The gunsmith had replaced a load of seals and a valve. This work completely transformed the Weihrauch- it is now extremely quiet - much quieter than my old AA S410. The shot capacity is also very good now- I would guess around 140 shots using the 200 down to 90 bar range. It is also punching good as one hole groups at 20 yards in the yard. I might try putting it in the fridge for a bit to see if it still looses air when cold. Not really sure what to take away from the whole sorry episode... Surprising to have had problems with a brand new, top of the range rifle, from a manufacturer with such a solid reputation for reliability as Weihrauch. I'm inclined to give the retailer the benefit of the doubt with regard to them being dishonest in this matter, I think they were just very slack in their customer service. I' ll certainly think twice about taking my business their way again though, no matter how local they are. On the upside, I can get out shooting again. Quote Link to post
