Working notice

Been offered a new job and I took it , I wrote my boss a letter saying I was leaving and put it on her desk on  the 27th Friday morning 9am my boss text and said she’d be in at 10 then again at 10 saying she’d be in at 12 , any way she never come in , and she got the letter this morning and is saying that she has to take today as my first day of notice ( I am owed 2 days holiday) so I think I should finish on may the 23rd but they are saying 25th ? 

Am I been thick or is the 25th [BANNED TEXT] ?

It should say in your employment contract what the time period is (check it to make sure you're giving enough notice!) and it begins at the time you hand that notice in. In your case, it's Friday 27th.

Bank holidays do not have to be given as paid leave and can be included in part of your holiday entitlement. That will be at the discretion of your employer.

You are legally entitled to take your 2 days as part of your notice period. You're legally entitled to be paid for it regardless of whether you work your notice or not. If you have to work the full notice period and they don't allow you to take the 2 days they have to cash you in on your final pay day.

She should accept your notice from when received by the company, not personally. However, leaving on good terms is priceless so I would tell your new employer and ask if he would vary it by two days so you can have a break - if he says 'rather not' then forget the 2 days and ask for holiday pay instead. 

Its always the employee never the boss - but she did know she just didnt give you her proper attention - therefore holiday pay.

I understand mate, I,m pretty unemployable if truth be told, so I,ve never had paid hols or sick pay or anything else, I just get payed per job and if I don't like someone I just gel on to the next one,  so though I,d tell her to do one and just go, you have to do what sits best with your own conscience and brings the best result for you and your circumstances, good luck which ever route you choose ?

just got a letter saying that because she did not receive my notice till to day it has to start to day ! But she was ment to be In on Friday and it was dated Friday and was on her desk at 9am friday ,

Look at this handy government pamphlet on your rights regarding giving your notice. It will go into more details but I refer the honourable gentlemen to the comments I made earlier in the thread. But to recap...

  • She cannot decide when you gave notice. It's from the date submitted not the date received. At the latest is starts the day after you hand it in which would be Saturday 28th, not Monday 30th. The amount of notice required will be in your employment contract.
  • You are not entitled to be paid for bank holidays and they can be included in your holiday entitlement. This will be in your employment contract.
  • You are entitled to receive your holiday pay either with leave or with financial restitution. This is a legal requirement.

Don't take my word for it, though. If you want to push the issue contact ACAS. If you think it's going to f*ck up your start date with your new employer contact them and explain the situation. Leaving on good terms is one thing. F*ck*ng up your reputation before you've even started is something else.

Just work your notice period and don't take the holidays, you can't be made to take them and they will have to pay you for them
