Yes it was a tragic accident imo. Her paranoia was a factor. Telling the goverment she no longer wanted royal protection as she belived they were spying on her.

If they were protecting her that accident would never have happened.

 

As far as he state and more importantly the monarchy severed links with her after divorce she was no longer a HRH do what she wanted as far they were concerned.
