Well that's the law, just because the people and government say one thing doesn't mean that that can happen outside of our established constitutional processes. The whole point in having a parliamentary democracy made up of representatives is to remove the volatility of direct democracy. The referendum is an example of direct democracy. That can still work under the representative system we have so long as we hold them accountable to enact those decisions.

 

If in the future we want referendums to be legally binding then we should have that written into law.

 

I don't really see this as an attempt to subvert the will of the people so much as our parliamentary representatives doing their constitution job of overseeing the government's actions. Is this about whether we should leave the EU as the people want or about monitoring how the government do it.

 

I don't like it but it's part and parcel of our representative system.

This looks, to me, like simply parliament wanting to see 'due process'......

 

The courts decision doesn't challenge the referendum result in any way. Parliament voted to enshrine the European Union Act, and it has to vote to repeal it.

 

Having said that, I'm sure there will be some who try to subvert the process, and we have to wonder exactly what can of worms the court has opened !

The elected government have a clear mandate from the people......what is there to talk about ?

 

I think they will use this decision to delay article 50 for as long as possible.......in other words sticking two fingers up to voters by the back door (sounds like a job for Keith Vaz ! )

Jerermy vine Is loving it!.... Tbh I can't see this making much difference.. These systems are in place to protect us and this is nothing new it's been said from before the referendum that for it to be legal under law then parliament would need to vote on it... May is already pushing for a appeal from the supreme Court and that appeal is almost certain to win once the full facts are put forward as this is only a initial ruling based on the basics of law .... But don't get me wrong there's always a voice in the back of my head asking are we being fukt over.... Keep calm for now let's see what happens nobody said it was going to be easy.

It's a victory for the rule of law, no more no less.. All the major parties have said they will respect the will of the electorate, my biggest fear is they will add unreasonable conditions to secure their vote to trigger article 50..
