The court found the the man liable to pay the £85 fine to the private parking company. This will now be considered a test case so from now on private parking companies will be taking every non payment to court and in the vast majority of cases will win. So it will be advisable from now on to pay the fine straight away and not let the charge increase. Too late for me as I have one which has gone up to £150 Quote Link to post Share on other sites

The other two came down to an argument in a carpark with me and my mates, and him with his, he started on my mate about his ginger hair, mate let the ticketer have one, and we all piled in, not heard from the ticketer, and that was 3 years ago, some you win, some you lose. Malt 379 Posted November 5, 2015 Report Share Posted November 5, 2015 If you get a private one, the best cause of action is to offer a payment equivalent to what they'd normally charge for the amount of time you'd spent in the car park. If you have offered this and they then refuse it and take you to court, you then have evidence that you have tried to cover the cost to them that they could have incured by you car taking the space of another paying customer. Also, It's not a "fine", private car park operators are not allowed to fine you, and if they use that word in any documentation relating to a charge they want you to pay they are breaking the law. The charge is what they say you have agreed to pay for breaching a contact with them when you outstay the allotted time or don't pay for a ticket. Quote Link to post Share on other sites

"By parking in this car park you agree to the following terms and conditions..." Bla bla bla. But people want to park there and not agree to the terms and conditions? The mind boggles. I park on Asda and Matalan with the missus at least 3 times most weeks. It's £1 parking which can be refunded in store. I never bother. One day I will get the £50 charge which it states on the sign. Lloyd90 509 Posted November 7, 2015 Report Share Posted November 7, 2015 f**k sake I had one today and thought I could ignore it. 1) I was on a road by an industrial park NOT A CAR PARK. 2) The sign that was supposed to display that you can't park there was for some reason totally blank so there was no way you could read the terms and conditions.
