thats why we walked with it...??? they would got conviction if charged with trespass

There was a thread about this on here last year but I can't find it.

 

It does happen. A lad I know got a 9 month ban last season.

 

And he was self employed and needed his licence to earn money (drive a van) and they still took it.

The hunting with dogs Act is not a recordable offence apparently but trespass in search of game is and because its a criminal offence they say you use the vehicle and your licence in the commission of a crime . so they have been known to suspend driving licences of all in the vehicle not only the driver. They also confiscate the car. A few lads have appealed these bans and the confiscation of the cars and have been succesful in their appeals

I has a court summons for "hunting with dogs under the 2005 act". I could find the paperwork for the full wording but it definitely wasn't trespass in pursuit.

I see these free men on the land say that acts only apply if u consent to them as tresea May said we are policed under consent so we must consent to be governed if we do then acts are then give the power of law if we consent to it but don't think this would hold up in law or guys be doing it lol

A lawyer once told me it not wat you know in law its what they can prove lol is there trespass in scotland though ? It would be nice if they lift the ban but to be honest I don't think they ever will but at least most of us rembember when a man and dog could without any hassle good old day eh
