Some regions say not to worry, others refuse a temporary certificate (others grant them) and then others tell you to lodge guns with a RFD as you are currently looking at a 5 year jail term for illegal possession of firearms! Alsone 789 Posted June 9, 2015 Report Share Posted June 9, 2015 I think this is another area where the BASC needs to get involved to get a National Firearms Policy that forces the police to issue a temporary certificate where the existing certificate expires before it can be processed, whether it's the fault of the force or a late submission from the holder. It's unreasonable in my view to have an incoherent policy that varies from force to force especially where members of the public are left in some circumstances committing a serious offence and only free from prosecution at the grace of the police, who lets face it, aren't always all trustable. With all that in mind, personally I'd transfer them and the ammo to a friend or lodge them with a RFD unless you have a temporary cert. Never rely soley on the discretion of the police, especially where firearms and strict liability offences are concerned. 1 Quote Link to post

Mine magically was delivered the day after that request. This is assuming you got your renewal in within the stipulated time frame. Quote Link to post

Alsone 789 Posted June 10, 2015 Report Share Posted June 10, 2015 (edited) All joking aside, just be aware these are strict liability offences which means there's no discretion in this. If you were to be taken to Court, you would be found guilty irrespective of it being the police's fault or whatever they said. All the Court would be allowed to consider is "were in possession of a firearm" and "did you had a valid licence". They couldn't take into account the reasons why you didn't or the fact that it was not your fault. So be careful. Gun + lack of valid licence = conviction. airbourne 128 Posted June 10, 2015 Author Report Share Posted June 10, 2015 Just rang them up again they said that it could take up to 4 weeks to issue, and that it is the same all over the country, i told them that by not having a licence i am breaking the law, they said it would be them that took me to court but they would not have a leg to stand on because it is their fault that they are behind on issuing licences, they assured me that i will be ok ,i asked about a section 7 and if i want one i would have to e-mail them to request one Quote Link to post
