Foxes In Bales

Dumb question, I have been asked to shoot some foxes locally, they are in the bales, would I be breaking the law letting the terrier flush them out and shooting them? I.e. classed of being to ground? My own choice I am going to try and put this off to September, I don't like leaving cubs.

I kind of know what people are going to say, but I did wonder.

the law is a strange 1 to follow ,,apparently you can use a soft type terrier to flush from earths or hiding places ,,i.e bales,,and shoot them, flushing from cover you are only allowed to use 2 foxing bushing dog.which is ok for us ,cause we have 1 foxing beagle x and 5 rabbiting 1,s.

seen lads nearly killed in bales happened to me 2 years ago lad released to dogs like an idiot after being told 1 dog was enough, dogs started scrapping when they caught up with charlie.I climb down and had to tunnel in end up falling down upside down took 2 lads to get me out never again and as you will expect that lad as never been with us since

Yeah all these things can go wrong, I would only ever send one down. The ones I am thinking off I hope are just a straight tunnel in the crease of a round bale, but you never know where there are gaps. One of my dogs won't go in far, the other one gets in and through them like a ferret, but I wouldn't fancy her chances facing a fox, she is only small.

I just read this properly. I reguarly take 3 dogs rabbiting. You bump into the odd fox. Does this include lurchers or just flushing dogs? (

I kind of meant do they count within the flushing team, but if you are after foxes then it all becomes a bit irrelevant, I have read the hunting act, it pickles my brain a bit (not that it takes much), I can see what they did, trying to legislate something that isn't black and white without leaving everyone open to prosecution from accidents etc.
