Her comments came after new forecasts wiped £9.6bn off expected North Sea revenues over the next five years. But in an embarrassing move for Ms Sturgeon, his aides yesterday said the Commissioner did not yet know about the legalities. Critics also pointed out that Ms Sturgeon should have met EC Taxation Commissioner Algirdas Šemeta to discuss the issue. Labour’s Scottish health spokeswoman, Jackie Baillie, said: “This is an embarrassing gaffe by Nicola Sturgeon. Not only has she been caught out misrepresenting the position of the Commission, she has also met the wrong Commissioner. “If she is so confident, why does she not come clean and finally publish the legal advice, her proposed minimum price, and formally notify the EU?” This is an embarrassing gaffe by Nicola Sturgeon Labour’s Scottish health spokeswoman, Jackie Baillie The Alcohol Bill could become law before the summer, although ministers have yet to set a minimum price. The Bill, which replaces measures defeated at Holyrood in 2010, is almost certain to be passed under the SNP’s overall majority. The SNP said in 2010 that the minimum price would be 45p. Some opponents, including the Scotch Whisky Association, claim the pricing measure would be illegal within the EU because it contravened free trade legislation. Ms Sturgeon was in Brussels on Tuesday to discuss the plans. Later, her spokesman said: “The very clear message coming from the Commission was confirmation that minimum pricing for alcohol is entirely compatible in principle with EU law.” The SNP was yesterday forced into a hurried correction when a release stating that MSP Bob Doris welcomed “confirmation of the Scottish Government’s plan to introduce a minimum unit price is permissible under EU law” was changed to read, “is permissible in principle under EU law”. A spokesman for Health Commissioner Mr Dalli said: “We will have to check if Scotland’s proposals are compatible with EU law.
