I understand what you are saying Dan, and perhaps I should have included even a keeper ONLY has civil powers of arrest, unless he/she is a special constable, otherwise said keeper has no more power to detain than a man on the street.

under the Game Act and the Night Poaching Act, he is. A specific power of arrest is conferred upon, among other roles, the gamekeeper, to enable him to require the offender to quit the land and give him his name and address. If the person so required refuses, it is technically lawful for the gamekeeper and anyone acting on his order to apprehend the offender and convey him as soon as conveniently possible before a justice of the peace provided that no person so detained shall be detained for longer than 12 hours. Any longer than this, the person must be released. In practical terms, the gamekeeper would then hand the offender over to the police who hopefully would take the necessary action. The gamekeeper is also permitted to relieve the trespasser of any unauthorised game in his possession.

or do what a keeper i knew did (was sacked for it ) throw the poachers in a barn ,lock the doors & knock the crap out of them :whistling: (not recomended ) :hmm:

Definitely not recommended a keeper us too easy to lure in for a good hiding. The poacher has always got the advantage in that situation as he knows were the keeper is.

Yes Dan correct all covered by citizens arrest powers which a keeper would be acting under, the same as a store detective/security guard, a keeper has the same powers of arrest as a normal first class citizen, not those of a police officer, so going back to my earlier statement, a keeper is first and foremost required to escort/ask to leave any persons poaching, unless they were going to assault him, what right minded person would not leave at the keepers request?In doing so the keepers CIVIL powers of arrest are negated, it would not even be "technically" lawful to affect an arrest under those circumstances.

Bear in mind if you make a civil arrest and the person you arrested turns out to be innocent, you have potentially put yourself in a position where you could be liable to prosecution. You would put yourself on very dodgy ground if you arrest someone and haven't personally witnessed them committing a crime.

Out on a permission last night the first time in months. I've been giving it a rest as the numbers just aren't there anymore. Through the summer I hardly seen any so left them alone, hoping their numbers would recover. There's been touch of maxi.

Anyway I did see a few but they were very alert and skittish. I was using NV my buddy was using a lamp. We were a fair distance apart, When I noticed his light searching my area. Thinking that's a bit odd started over. The light went off and a few minutes later I realised it wasn't my mate. It was a bloody shooter who scarpered. I watched him cut away over fields into the distance.

Tried to head him off but he must have knew we were following as he dissappeared.

! I suspected this was happening as the past 2 years aside from the lack of rabbits their reaction to a lp is incredible.

Any suggestions how to deal with poachers.

No no nothing to do with nv making it much easier to kill everything.....must be those pesky poachers lol

If they are not doing any damage then learn to live with it,the land and game should be accessible to all who treat it with respect.

meaning it requires the consent of the governed,which may or may not be who your attempting to detain (not arrest).

 

'do you understand?' means do you stand under my authority i.e consent.

 

is there any precedent set for poaching tame animals like pheasant etc being theft?
