They may be responsible for it's upkeep as a public highway but the land underneath it, which is the important part and referred to as "sub-soil" in law, is unlikely to belong to them. The sub-soil is accepted as belonging to the adjoining landowner. Same principle as a leasehold house. You may own the bricks and mortar that make up the house, but the ground underneath it is owned by someone else. Quote Link to post
