A couple of lads I know quite well were arrested for walking along a road with a lamp and an 8th month old pup. I kid you not the way the police drove up it was like they were arresting a terrorist not a couple of teenagers. They've been back to court a couple of times and it's still not over. Worst bit is this was about 40 yards from there parents property and the field running alongside the road they were on they had full permission to be in !

I got caught in similar circumstances but I was on a public footpath near my vehicle. Gamekeeper collared me till police got there, they took my lamp off me and interviewed me but dropped the charges a day before my court date. Lasted 6 months but I got my lamp back. Point of story is admit feck all

Ps they told me I could have my lamp back the day after and I wouldn't be charged with anything?? They 'lied'

the gamekeeper has no right to detain you for at the time only guilty of tresspass which is a civil offence. If he made you stay against your will that's borderline kidnap.

The Night Poaching Act 1828 – Poaching by Night
It is an offence, without permission and at night:
 to take or destroy any game or rabbits
or
 to enter or be on any land with a gun, net or instrument for the purpose of
taking or destroying game (does not include rabbits)
or
 for the purpose of taking any game or rabbits, being 3 or more persons,
and any one person being armed with a gun, club or other offensive
weapon.
Anyone found committing night poaching may be arrested by the owner or
occupier, their gamekeeper or employee, or person assisting them on the land or
adjoining highway, road or path. The police have separate powers of arrest, etc.

it says if more than 3 persons or if they are armed, trespass is a civil offence and is not an imprisonable offence so powers of civilian arrest would be very limited, in fact it could escalate a civil matter into a criminal one .

Been back today, was handed further charge sheets before we went in saying we're charged with entering land (tresspass) with poaching equipment in pusuit of taking or destroying game. When we got in the court Room they said the scrapping the old charges and pursuing the new ones then asked us how we plead, we all went not guilty and have to go back on sept 15th. What a load of bollocks

 

If you are representing yourselves I am sure you can demand to see their evidence upfront. And if you get a solicitor I am sure they get it beforehand as a matter of course. It makes sense, as you can't be expected to gather all the relevant facts and get your own witnesses for your defence on the day!

 

It is still innocent until proven guilty in England, although sometimes you wouldn't think so according to the media. Good luck - but from what you say it should be thrown out of court.

well I know this when I used to have to get the police out (old head keepers choice not mine) I have never have been arrested or charged with falsely imprisoning poachers and I very much doubt I ever will be since the night poaching act makes it very clear that if I as the keeper believe a person is poaching (walking a lurcher and carrying a lamp would suffice as reasonable suspicion)whether I catch them on the estate or adjoining lands I can arrest and detain them till the police arrive, I however can not do so during the day the only thing possible then is as an agent of the land owner I can demand you provide your name and address and that you leave or return to a public right of way if you do not do so I can use reasonable force to remove you.
