New Waste Regulations

Hi lads,

 

Having a bit of a headache over this new waste regulations, I have registered as a low tier waste carrier and have looked on the gov waste website 26 pages of confusing information!! I think I just need to keep a record of what spend bait I collect and send it in every 3 months? Is this correct?

This whole thing seems fairly simple to me in the main, just more expense and poxy paperwork!   The one thing we don't need in the pest control industry is paperwork!   Killgerm have been helpful,

typical you get grief when you're doing something out of the kindness of your own heart.   Did you eat the bird? It couldn't be classified as waste if so..... Just a thought....

Okay, so I was wrong, again! Killgerm just sent me this:

 

The Environment Agency has confirmed their position regarding public hygiene pest control spent bait and related items. The following information explains this position and the implication this will have on all pest controllers in order to comply with the law.
• This position is valid in England and Wales only
• A consignment note needs to be generated for all spent bait, items contaminated with spent bait (e.g. bait boxes, PPE, packaging) and empty insecticide bottles etc.
• The pest controller needs to register as a lower tier waste carrier and ensure that his carrier registration number is included on the consignment note
• Every three months pest controllers must make returns using the EA forms using information on the consignment notes, paying a fee of £10 for the return of each classification of waste. This would mean that a maximum charge of £30 could be made if all three classifications of waste are returned (fluorescent tubes, municipal pesticides, aerosols)
• When items are removed from a customer’s premise with the intention of reusing they are not classified as waste and do not require consignment notes and returns to be generated
• These charges only apply to items used in commercial treatments. When items are used in domestic treatments these do not require a consignment note for the movement of that waste back to the pest controllers store, but a consignment note will have to be generated when moving that waste to a waste transfer station or disposal site.
This information is in accordance with The Environment Agency’s current Regulatory Position Statement and if it is not adhered to this derogation will be removed. The removal of the derogation will result in a charge of £10 being made for each consignment (movement) and therefore result in much higher charges by The Environment Agency to the pest controller.

I’m reading this as:

 

Register as a low tier carrier. (tick, done that)

 

In three months time you’ve got to get rid of all the empty boxes and shit that’s piling up in your stores and send it away with a form that costs £10 from the EA.

Then in six months you do the same; then nine months, so on and so on.

Hope that’s right.

 

Where would I get the EA forms? The Environment Agency’s website is it?

Welcome to my world.

As a gardener if I take away waste I have to fill in a waste transfer note, give a copy to the customer and then more paperwork at the dump.

No waste carriers license no dumping.

 

This is a whole 'other' ballgame....

 

Historically, pest control waste has (in the main) been treated as 'controlled' waste (the same as garden waste etc). It's now been reclassified as 'hazardous' waste, meaning much tighter restrictions, more expensive disposal, and a huge pile of paperwork.

 

No reason for the change other than some misguided civil servants thinking they're saving the planet by creating an even more complex paper trail.

 

Complete and utter nonsense that just makes me relieved I just trap moles now. Thankfully, dead wild animals (unless they contain rodenticide) are exempt from the Animal (By Products) regulations so it's business as usual for me, but spare a thought for all the hard working pest controllers who now have the complexities of the Environment Agency lunacy to deal with on top of new label restrictions on rodenticides.

It seems that government doesn’t care what the so called representatives of pest control have said on the topic.

 

But MPs will care about loosing your vote!!

 

 

Maybe someone on here who is good a writing letters could kindly knock-up a draft letter for all of us?

Great idea Muddy, I'm crap at putting a letter together but I would definitely send my MP one if I could print off one that is well put together.

I agree with you too Matt, I am a sole trader ( extremely busy ) and now even more time taken away from me filling out forms instead of enjoying what little time I have with my kids !

Here’s my attempt at a letter to my MP.

I could really use some help with this lads :)

 

 

“Dear……,

 

I am a constituent of yours who works in the pest control industry.

 

Some new, completely unnecessary, legislation has recently been introduced, regarding the way a professional pest controller must deal with the waste packaging they create.

 

…….here I really need a concise explanation of the changes and how ridiculous they are…..

 

You may, or may not be aware that the majority of pest control companies in the UK are sole traders or very small companies. The excess of new paperwork associated with this change in the law will create an intolerable drain on the time and funds of such small businesses. Many might even feel they are no longer able to continue trading when faced with this new bureaucratic burden.

 

A loss of pest control companies will mean either a massive increase in the spending of local authority pest control departments, a massive rise in the population of rats or possibly both.

 

I would be extremely grateful if you could bring this matter up with….. I’m not sure who best to bring it up with, the EA?...... and try to have the new legislation on pest control waste removed.
