Moles Next Door To My Permission

Things will most likely come to a head when the grass cutters see the state of it in the spring.... it happened here; no-one bothered for years, and then the grass cutters moaned when they had to have their mowers re-ground.... then they started renting the field to an 'outside' football team who moaned like hell.

 

Shortly afterwards I got the call...

 

Once under control they keep an eye on it for me and just phone when any new molehills appear.

 

It may be worth pointing out to them that the problem is only going to get worse all the time they ignore it, and that it's now having an impact on neighbouring properties. Grass growing is a natural occurrence, but it doesn't stop them paying someone to cut it.

The problem's not necessarily the molehills you can see but the runs you can't... If someone was running about on t'land and a run gave way causing a kid or anyone to break an ankle, the parish council can be sued as moles are a hazard that can be controlled.

You can attend any parish council meeting.

 

I don't think there would be any problem with an outsider attending and asking why they are ignoring the obvious health and safety issues, but I don't think you can push too hard unless you are a parishioner though. It may be worth speaking to your District Councillor, and also have a look at the PC minutes to see when the field was last risk assessed for the liability insurance (that may be the question to ask).

 

The landowner has a duty of care to the public to make sure that any controllable hazards are actually controlled. In effect, they are leaving themselves wide open to a claim of negligence if they ignore an obvious trip hazard created by molehills. Other hazards include the risk of stones flying up when the grass is cut, and the risk of soil born bacteria if children play there.

 

It may be worth speaking to the grass cutting contractor about the problem and/or canvassing some opinion from parishoners and other users.
