You lads guessing at things like 'he was speeding'..'he threw the first punch'....is that what you would say to someone if you just smashed your car into a wall???? Now we have established it was the postie if be taking it up with them. If the postie did leave the gate open just how is he responsible the postoffice will have two words for the op when he takes it up with them they are JOG ON I complained about our postie using my drive as a rally stage it worked a treat instead of slowing him down they just stopped delivering my post had to collect it from the sorting office till I apologised for calling him f*****g colin mcrea my opinion the op needs to take responsibility for his dog and his actions he caused the accident by his negligence there is actually a sign on the gate close the gat and beware of the dog i think i might have a good chance tbh with me sparking the bloke i mean you can clearly see him getting in my face and putting his head against mine and pushing i mean i no its not a real assult but i should be able to say i thought he was going to attack me and was being verry aggressive Quote Link to post

I'd be more worried about being being locked up than whether he's going to come after you for some damage claim.To be honest mate you sound like a hong gun that has over reacted and is now in the shit.......get yourself a brief if you haven't already. Best of luck. Bell Must admit, if some boy had came up in my face shoving his head up against me, I would have a hard job not clappin his lug either! Easy to say, that he over reacted, but in the heat of the moment, it would be very easy to do the exact same thing. He has no FAC to consider, this may have affected you or my reaction.....but really, would it have sprung to mind given the same situation? Shame to hear the dog's in a bad way. Bell i told them to look at the cctv and then no comment on the rest n brief wise ive had the same brief for 18 year mate but only bother him if needed if i get charged ill give him a bel but tbh had a little word and might be coming to an endfingers crossed Quote Link to post
philstory 83 Posted December 2, 2013 Report Share Posted December 2, 2013 without speaking to a solicitor your unsure. every case is different but like said before you haven t done yourself a favour by clipping him! as far as I have heard before you have to avoid hitting the dog so if he has hit a wall it s his fault. maybe driving to fast in a built up area! treecreeper 1,136 Posted December 8, 2013 Report Share Posted December 8, 2013 cant quote, but as above, If you need the cctv you don't want them having the only copy. think i also saw the one described above two horses escaped, long story short two dead horses and two people dead I think, but no action was brought on horses owner due to lack of evidence. ill admit if some twat came banging on my door right in my face after squashing my dog I would probably nut him too. good luck.
