Trespass is not a crime. Civil offence only. You can only sue for damage to the property trespassed upon. No damage, no case, simply put

 

Not always. It is a criminal offence to trespass on British Rail land.

Rail act agreed, but op didn't appear to be British rail. Just giving facts based on facts. It's also illegal to trespass on mod land, again not relevant to op. then there's armed trespass but as no guns involved not relevant!

You could try aggravated trespass (basically trespasser preventing you from enjoying quiet enjoyment of your land. A fine point in this case as he was strimming (helpful if anything)

Boundary disputes are commonplace.

If you own the land prove it with deeds then stake out a fence and enforce boundary. If you let it happen then technically after time trespasser can claim it as there's under some kind of desertion legislation. Bit like squatting for over 7 years.
