Ray Mears 272 Posted January 8, 2013 Report Share Posted January 8, 2013 (edited) would you really go in one field with this sign........? theres a million fields and your asked to keep your mutt out of one..........why would you go in,.why ,..why.........any one entering that field is asking for trouble........... they can shoot a dog any time or any place if they want ...............bit late when the dog is dead .............all they will get is a tap on the wrist,..........despite the law your on private land ............. and that will go in there favour................... as for the title of this thread ,.how do they get away with this ...............there just warning people to keep dogs out.............is that a crime ffs they cannot shoot a dog anytime or any place and yes i would enter it BECAUSE THEY HAVE NO MORE RIGHTS THAN THE FARM NEXT DOOR WITH NO SIGN. i aint on about taking it to court mate your too much hard work..........mate bring your dog around here and i will show you how easy it is to shoot a dog ............do you think they care about whever there aloud or not................ what are you on......... me mates had a twelve bore pointed at his dog because the farmer said he had been coursing deer ,.........no live stock for miles ,.......theres some strange and worrying land owners / farmers about and they dont care about any law .........fook me most of em havent seen a telly and is still inter breeding with there sister lol...... me mate picked his dog up and held it up to his chest just hoping the loon with the gun would think twice before pulling the trigger........ you be surprised what fummy fookers are about........., theres throw backs in all interbreeding ,.........at least this farmer is warning you lol just because there is a sign means nothing they have no more rights than a farm next door without a sign. you can go anywere and they can come out with a gun just because they have a poxy sign up makes them no different to the bloke next door? i can see were people are coming from saying keep away but if every bit of land had a sign like that up no one would take a bit of notice.... just be fecking normal ....please i am what i am i refuse to be a robot its all the time spent on my own in the woods eating spiders sent me wild Edited January 8, 2013 by Ray Mears 1 Quote Link to post

Farmers do not have a legal right to shoot dogs that sheep worry what they do have is a legal defense for their actions and this is far from an absolute defense. The charge being criminal damage the dog owner then may subsequently take out a civil action against the defendant, The defendant (farmer or agent to the stock owner) would need to prove to a court that their actions where lawful and that all other possible means to stop the worrying had been tried before the animal is shot. A person who shoots a dog on the premise of stock worrying would also run into firearms law the use of a rifle to shoot the dog would no doubt breach the conditions imposed on their firearms certificate.I am not sure but I doubt any firearms licencing dept would issue a rifle for such a purpose. The dog owner does however commit an offence of stock worrying and upon conviction the stock owner would be entitled to damages. It is also worth adding that wild animals are exempt from these rules and this also includes game birds so a dog owner cannot be convicted of worrying wild deer,pheasants etc and nor can their dogs be shot. wirral countryman 2,110 Posted January 8, 2013 Report Share Posted January 8, 2013 Well,just caught this thread and it could never happen in cheshire or merseyside,it would only take one phone call to report the farmer for threats with a firearm and his licence would be gone in a flash,my brother has a farm with sheep and he had signs up everywhere to deter lads with dogs,he stopped some lads with his shotgun with him,these lads dog were chasing his sheep everywhere,he never fired a shot but told the lads to f*ck off or else,2 days later he was stopped going down his lane by the armed response and arrested,another team with a helicopter raided his farm where his lad and wife were cable tied and made to sit down whilst they brought his keys and siezed his guns,all this happened because of 1 complaint,it took him 2 yrs to get his guns and compensation for wrongfull arrest because they never read him his rights,in court he told the judge he had signs up etc and he was allowed to carry a gun on his own land,this was proven to be wrong as they said it only served to show his intention and as such would be classed as a planned,pre-determined act making it much more serious offence,we all carry phones these days and a photo or recording of a threat will see anybodies licence removed.I personally throw every sign saying private or otherwise straight in the nearest pond or bramble if ever I'm somewhere I shouldn't be,even poachers have rights,get rid of the signs would be my advice,and if you have any problems phone the police yourself,but use your head and keep the dog on a lead around that farm,WM Quote Link to post

Around 40 years ago, a 'keeper shot one of my dogs. It was in a field with me, no stock, no crops and not chasing anything. The 'keeper got the hiding of his life, and my brother and I were charged with GBH and Trespass In Pursuit Of Game Or Coney !! We retained the servces of a top Brief, (ironically a Q.C. for the RSPCA !!). He tore the 'keeper to bits during cross examination, and completely discreditted him. We were found Not Guilty of all charges; and the 'keeper was later charged with Unlawfully Killing A Dog. Its wrong....Ok, i totally understand that if you dog goes mullering his livestock then it deserves to be dealt with but this could seriously scare a kid into not wanting to walk his or her dog... there sthreats and blatant gall needs to be treated likewise . atb bunnys. He said shoot me and theirs loads of witnesses here so you'll be done for murder. Another time, half a dozen 'keepers blocked me in at a pub car park, and accused me of coursing hares. The got the police and all six of them swore they had seen me coursing. I was arrested and charged and duly was up in front of Blyth Magistrates. I didn't get a lawyer as I thought I would get away with it. When I walked into the court, I saw, to my horror, that one of the three Magistrates was the land owner of the place I was supposed to have been coursing !!!! He leaned over to the Clerk Of The Court and said "Whats the maximum penalty ?" The Clerk replied "£60" !! I just pleaded guilty and paid the fine; that made it one to them and one to me !! LOL !! A decent Lawyer would have had that thrown out of court, but his fees would have been considerably more !! Cheers. 1 Quote Link to post
