Guest thebigdog
If he's got pictures of dogs and badgers then more fool him. He's made his bed, so he best lay in it. Is it illegal to have pictures no. Go on you tube e.t.c you'll see hunting from all over the world of various types. illegal no, but in this climate it's plenty f*****g stupid 3 Quote Link to post
baldockbanks courser 598
why doe h not just say the pics were taken in ireland yrs ago All of these pictures were presented to Cambridge magistrates in June as "bad character". The 3 magistrates after listening to the explanations given in the witness box dismissed them, some were taken in Ireland and by third party's e.t.c so you can see they were not deemed directly linked, and that was in a court of law once already. On the matter of legal aid, do you think I'd by wasting my time on here if he could get legal aid? He couldn't in June so it's very unlikely now. Quote Link to post

kane65 2
been in a similiar situation 10k sounds alot but there was there was 3 off us involved cost just shy of 70k for the 3 off us. two terriers and a lurcher taken by sspca. we where all found not guilty. had we had just the run off mill solicitor ie legal aid solicitor things would prob be different. clive reece like the solicitor we had are proffessionals in that field and know all laws and loop holes. dont underestimate the currupt ways of sspca and rspca . they will say and do anything to get a conviction. i have witnessed this at first hand and aint nice . all the best with the case 2 Quote Link to post

No offence mate BUT why isn't the accused on here asking for help, how would this fund be set up and how would we know that if we gave anything it would go where you're saying? Don't mean to put dampers on it but this could easily be a scam. 1 Quote Link to post

That persermistic approach is all well and good but we beat them once already in the face of greater adversity than this believe you me. he just needs a fair chance to put his case across. What did W.churchill say? We shall never surrender. Quote Link to post
desertbred 5,490
as this doesnt appear to be a private prosecution by the RSPCA then a full section 1 commital should be asked for at the magistrates, if this is a criminal prosecution then the DPP would have to consider how strong thier case is and then produce all thier evidence before the magistrates this would test the water to see how strong the case is and the case may well be dropped. it cetainly appears Mr Reece is taking the micheal. Clarrisa Dixon is a Barrister dont know if she pratices or not but she was prosecuteD for coursing a few years ago maybe she could give some pointers in the right direction or some up and coming legal eagle provide probono to support the hunting lobby atb Edited December 12, 2012 by desertbred Quote Link to post
Brewman 1,192
As far as I know if he is found not guilty he shouldn't have to pay in a criminal prosecution. If its a civil prosecution its up to the judge to award the costs in any direction. If there is a fund being set up i would happily contribute to it. It's a bit iffy for the rspca to take such a stance seeing as this will cost them because they need to raise a number of times more the amount needed but then its not their money and that's probably the reasoning behind it. Me thinks they are taking the piss leaning on the small man trying scare tactics. If it fails I think it will be a once off. sounds as if there trying to set a precedence so a conviction could be achieved on the basis of a photo without a clear link to the accused actually being there at the time the picture was taken, a very dangerous development if you ask me, as all alledged pre ban pictures would become questionable............. If and hopefully when this falls flat on its arse I don't think the public would be to chuffed to see where their money is going. I think they would be seriously hacked off at the hundreds of thousands spent on cases like this and not genuine cases of animal cruelty. 2 Quote Link to post

To be honest I don't really want to raise 10 grand for Clive's next trip to the moldeves, but I don't think the lad should be hung out to dry, there's plenty on here how'd vouch for me. I don't know the best way to organise it I'm just asking for help. Quote Link to post

I've had 6 not guiltys on the spin now and some had little evidence and or witness they just hope you plead guilty or crumble in the box. 1 Quote Link to post
