It's one of your free rights you have when being booked into custody! Take their advice they know what their doing, ATB Mawders Sorry Mawders, But I would have to say BOLLOX!!! When I was 'DONE' for POSSESSION of an illegal xmas gift, sorry Section one Fire arm (running at 13.04 ft/lbs) my FREE Solicitor advised that I should take a Caution I duely followed his instruction and admitted Possession (even though I was over 9 miles away from the item in question and I was neither Arrested or formally charged with the offence). If I had at the time been "of Sound Mind" (I had suffered a 'Crash/Secondary breakdown' due to being made homeless/lost job/divorced, sister dying etc :oops: ....) I would have spoken to BASC First thing they tell you in circumstances such as what happened to both Darryl and myself is DO NOT ACCEPT a Caution Like Darryl I made the mistake and accepted a Caution for 'Possession'. WHY? because we are both Law Abiding People! Doing so is an admittance of guilt (not only for possession, but as a side line it's an implied admission that we "Knew" it was illegal! Neither I or the person who gave me this gift knew it was running hot, the RFD that SOLD the gun in question when I spoke to him when I was better told me it was running at 11.76 ft/lbs, which of course is well within the legal limits. When my insurance is due for renewal (any day now) I shall be joining BASC, just in case anything like this happens again (I often buy second hand pistols). I can not be cautioned for a second Section One offence! So a Criminal Solicitor may not have the knowladge that a specialist Solicitor will have! Now because I and Darryl now have a "Section one Caution" we will never be allowed to gain a job that holds a "Position of Trust" Which means I will not be granted an SIA License to practice as a "Close Protection Officer" (Bodyguard) oe even as a gate guard! Darryl will find that if he applies for a job as a "Bonded" load driver, he won't get the job! A conviction expires a Caution does not! Tony I thort they did mate??? i hope your wrong because i took one for my hw90k running at a big 12.35ft'lbs the 7 .22 rimmy rounds was off years ago .. but was a laps on my parts and had sat in my old coat for 4 years so i took it for them..but a mate got let off for having 10 in his car when pulled over? I have been told by a couple of people (who wear the uniform) that if I were in either Bristol and Avon area or Cambridge area, the gun would have been allowed to be turned down, Humberside however say 'Not a chance' Tony Quote Link to post

ATB Mawders My "Bollox" was in dispute of your claim that "Your brief knows more about the subject than you do" sort of thing It is certainly not a personal insult to you Sir My appologies if thats how it came across If 'all' cautions expire, why did both the SGT who gave me the Caution and my brief say that a caution for a "Section One FireArms Offence" does not expire and I have to declare it if asked for the rest of my life? I'd love it if it does expire, maybe then they cant hold it against me when I actually apply for my FAC and maybe I can go back into the Close Protection/Security industry? Tony Quote Link to post

From a twisted and corrupt system that has the cheek to use the word 'justice'. I resolved never to outsource something so important to anyone ever again. So I studied it, in depth. Know your enemy. Tony Tony, I'll look into your caution and pm you. My post may not have come across as I intended it. I ment you have 3 rights. 1 to read the codes of practice which govern your stay in custody. 2 to free independent legal advice. 3 to make a phone call. Always ask for the right to legal advice, what I ment to then say was that you don't have to accept it! Regardless of what you think about solicitors miles they can be worth their weight in gold. Don't snuff your nose up at them because of your ideals! Miles I've tried to explain why you feel 'you won the war' against the police via our friendship and text. It doesn't mean that works for everyone. Some of the advice on here would get people in more trouble should they have the lack of real knowledge at their disposal. Let's keep this on topic and let people learn like darryl suggested rather than impart our own views on what everyone should do. It's a dangerous game. Tony also remember that policy and procedure between forces changes but PACE doesn't. Maybe your force has had more firearm offences or serious offences committed with guns so it has a zero tolerance stance on the matter. Other forces may send the rifle to an RFD for which you pay for and have the rifle turned down. I guess unfortunately for you your force won't allow that. ATB Mawders Quote Link to post

This was done by being very careful with every word not to give him anything he could use against me. When threatened with arrest, i calmly accepted and this showed him i wasnt afraid nor would my resolve be shaken. I was careful to be polite, but this does not entail submission. The police are public SERVANTS. I am a master. Know not just your statutory rights, but remember your god given ones. You, like me, are a Freeman, until you allow that freedom to be taken. 2 Quote Link to post
