nothing if it happened and you are just walking along a public walkway public area or bridal way and you report it to council, landowner, straight away then you have to leave the dog 24 hours then you get a license to get it out , i think it still works like that RSPCA will also look at the sett a meeting takes place it happened to a kid i no , don't have netts or spade or locator on you like !! lol

if you join the fell and moorland they have a rescue service and will deal with all the paperwork side of things aswell if ever the need arrises.

Even if you disturb a badger set you could get into trouble let alone digging out a terrier!

you can dig setts as long as you have evidence there not in use by badgers, this was stated by clive rees in countrymans weekly (i think). i wouldnt advise it tho.

i thought it was against the law to interfere with any set and i know there is a safe working distance from them.

there was rubbish about taking photos around a sett to prove they werent in use by badgers. we will get to the truth on this thread im sure...............

Yes the fact is even if its accidental it would be more likelly for the RSPCA to take out a prosecution as they do'nt require evidence or intent to start a prosecution unlike the police who have standards that the evidence must measure up to or they must account for their actions. Unlike the RSPCA who are accountable to nobody.

Someone tried telling me the other week their Russel was lost to ground for 19 days and when she finally came out was fatter than when she went in!! Either she ate her way through a family of pig or was holed up in someone's house being fed for a few weeks lol

This happened recently near Nottingham and I think the fire brigade were involved after getting the licence from Natural England. It was on local TV news and just for the TV cameras they took the dog to the same place and were letting it into the entrances on its lead. JMO but isn't that illegal.

if my terrier went to ground in a beadger sett i would phone the poliece and when they arrive' if within a halfhour ' if not i would start digging and if they say why did you start digging tell them you were worried for the welfare and safty for they dog and badger !

I would just get it out and keep me gob shut. RSPCA will have your bollocks given half a chance. I had a russell that would go to ground on a stripey funny cousin (thats what my Brother calls 'em)in a heatbeat. He was a hard little b*****d too. We've shifted tons of soil in no time to get him out,even though we are members of the FMWTC. Never involve the Powers that be.

well when you take into account a fox is a v smart mammal... what i mean is a fox usually would not dig its own hole!!!

it will use all sorts from drains to undersheds... rabbit warrens and USED or unused badger setts....even hollowed out barks of trees...joists of old buildings hay bales.. many more i could mention.

 

so ill put it too you this way if a fox is flushed... and you watch it run too a burrow or sett or whatever you want to call it.....

and you go down and there is dung pods everywhere heaps of fresh soil outside the hole and the pad marks of the boy in the suit going in and out..... KEEP YOUR TERRIERS OUT!!!!

 

but if you go down and its a badger sett but shows no signs of recent activity....ie... heaps of soil but its old and hard... no dung pits about...no strands of the boy in the suits hairs about..on fences or branches around the mouth of the entrance.... no pads showing signs there have been a badger or badgers anywhere near it recently... then you have the permission and are well within the law too net up and enter one terrier.... hope this helps....
