How would the law favour if say you where walking a terrier and it went to ground in a badger set ?

If your dogs are willing to go to ground you should always keep them on a lead around badger setts

you would have to leave it. someone once had a non working dog go to ground in a sett and had to get special permission which took near a week with the dog still to ground, and finally the dog was dug up by machines.

Read about it regular, often its the firebrigade who do the rescue. Lots of pet rescues done by the f&mwtc going by the yearbooks.

you can get a licence to distirb the set if the dog has gone down on land where you have permision to be
