Sporting rights are not pest control rights, The landowner could have a game shoot on the farm but the teneat farmer can still have someone on to do pest control.

Wouldn`t worry about it mate, sounds like the blokes a chancer. Talk again with the farmer / tenant.

the owner only owns the land..its the tenant whos put money in to buy grass seeds, corn etc.. so surely its his crops that your protecting. i would have thought if you've got the tenants permission yo

I'm pretty sure a tenant has an obligation by law to control vermin, how he chooses to do so is up to him.

Went too a farm close too home asking for permision guy was realy nice but he said he couldnt let us on as he was a tenant farmer but would love to say yes, now i know they do a lot of pheasent shooting when the season is in, but what harm would it do to get a few bunnies as he wanted us on there but couldnt give permision

Iv been in this same situation, It's upto the land owner not the tenant.

 

A farmer that own's the land is the only person that can give that permission...Nobody else.!!

 

The lad with the dog was well within his right's to ask you to leave if you dont have writen permission from the owner.

 

This the way it is mate im afraid.

Like I said..the tenant Does Not Have the right to give permission..There's another thing..The land owner's are by law only ment to allow so many gun's on his land..So how would the tenent know he's allowed his limit.??

 

Try this..If it was your land and renting to a tenent how would you feel about him letting any Tom Dick or Harry on it.??

I think sporting rights and pest control are getting mixed up here ,rabbits,rats or any other vermin are pests.......................A tenant farmer has a right to control vermin and pests on land he rents and has the right to appoint someone to do it. He may not, however have the sporting rights as part of his tenancy. (source BASC)

I don't think that's correct. :no: As has been stated by others, vermin control and sporting rights are two completely different things. In legal terms the tenant is the person who has authority to give permission for vermin control, and unless sporting rights have been specifically retained by the landowner in the original tenancy agreement, they also belong to the tenant. If retained, the land owner also has the rights to sell/give the sporting rights to a third party. Can't remember the specific legislation but this topic has been up loads of times in the 5 years I've been a member on here and has been proved conclusively.. :thumbs:

Its a tricky one this and one that as also bitten me when I lived in Catterick.

 

I used to shoot on many large fields managed and farmed by a man called John Wray.

 

I had written permission to shoot all vermin species on these fields as I did quite often.

 

One day I was shooting woodies and collard doves on request after they were decimating Johns crops. I was in a large field about 100 metres from the nearest house shooting up into a tree (away from the house direction) with about a 2 to 3 mile back drop of permission also mine too.

 

This woman comes over the fence into the field when she saw me get up from my static location and retrieve a dispatched woody all dressed in camo and face veil. I clear the r10 in a safe direction and remove my face veil before talking to her.

 

She in a very aggressive manner asks me what the hell i am doing in the field dressed like John Rambo shooting birds?

 

I explain that I'm carry out requested vermin control from the farmer and land owner Mr John Wray who's crops are getting eaten at a fast rate of knots.

 

To this she bursts into fire at me saying John Wray isn't the land owner and only the farmer that rents the fields from her 90 years old mother who lives in the nearest house 100 metres away.

 

I said well I'm very sorry for not getting the fine details correct but I have written permission and shown her it, signed by John.

 

Now bearing in mind I was using a Tench customised and tuned BSA r10 in .22 with a Twink MK 2 silencer fitted the lady then goes on to tell me that her 90 year old mother is frightened as the rifle is so loud that she cant have her afternoon sleep so i needed to clear off before she phoned the police.

 

To this I said ok I will go out of respect to her mother, but I will be speaking to John about the issue at a later time.

 

As I pack up and walk towards the fence with all my kit away she starts to follow me onto the street. I go to my car and she watches and then gets out a pen and paper and writes down my car reg number. I drive off and by the time I get 7 miles down the road to my married quarter and drive onto my road my lad comes over telling me the police had phoned and I must phone them straight away.

 

I phone them up and explain the situation and what the woman said and they ask can i pop in with my FAC for them to inspect. I say I was using a sub 12 air rifle and don't require a FAC to which they say oh we see now Mr Pittaway and sorry to bother you.

 

I then ask where I stand legally as I have written permission and they say the land owner as the final say not the person who rents the land but maybe Mr Wray and the old lady can come to a agreement on what I am doing for him.

 

It turned out the old ladies daughter was a veggy (which is fine) and anti and the old lady knew nothing about me or what I was doing.

Thats what gets me with the police sometimes Si, they just spew out some bollocks which they think sounds correct at the time. :yes: I can't remember the specific wording on the legislation, but somewhere in the glossary of terms for the specific piece covering this, it states that the term 'landowner' also applies to any tenant farmer renting the land in question. :yes:

 

Wish I could remember which piece covers this now.. :(

Cheers for all your advice lads. I'm still none the wiser!! Going to call at the farm tomorrow and have a word with him!

I'm really pxxxed off as loads of rabbits are showing at the mo, just don't want to go down that road of losing my rifle and getting done for armed trespass!!

I had this for year's and to be honest I kept shooting the land, but only because 2 shooting club's pay to shoot most the permission's I have.

 

When I first got the permission's, rabbit's where everywhere as the 2 club's are wildfoul club's..Not vermin club's.!!

 

When they started to see me shooting rabbit's & corvid's they started to complain to the land OWNER's AND TENENT's...The club even went and told the Owner of one of my biggest permission's that he cant give out permission because they rent it..The owner replyed I can give permission to who I want and went on to tell them they dont shoot rabbit's, magpie's or even the crow's.. The club started to put up signs on the gate's saying... FWA ONLY TRESSPASSERS WILL BE PROSICUTED.!! I in turn took them down as the had as much right to put them up as they had to tell me im not allowed to shoot on the land.!!

 

They then went on to compleatly depleat just about everything insight but to be honest i got i bit of a buzz out of it because now they where trying to intimidate me by shooting everything and talking about me telling a mate of mine whome iv known sinse i was a lad. There even to this day saying im shooting ALL the rabbit's And pheasnt's..But guess what...I havnt touched a single rabbit OR pheasnt on that land this year..NOT ONE..See they got all carried away and now they havnt got much to shoot when duck and goose season are finished..And they dont like waisting there expencive cartiges on magpies crow's and jackdaw's ect....But i love it..il shoot them ALL DAY LONG.

 

The other thing is they dont like walking far from there car's...Lazy Fooker's...and most the rabbit's theyv been shooting are from field's not far from the road..But hey guess what..I love a good old walk and there's still pocket's of rabbit's where i walk to...So theyl breed nicley and later in the season il go do my thing.

 

One of the little pr*ck' is called Dave Wade..he mones and tells people things that arnt exactly true but when i see him at my gun club he never say's anything to me in person :hmm: not even once.!!

 

As for the tenent's farm they have now changed hand's and i know who they are and there very strict on people shooting so I just dont need to bother askin..plus iv got 100s of acer's of land all over the place :victory:

 

Edited...Oh i forgot to mension, This club is a shootgun only club.. single Projectile's are srictly forbidden..But for some strange reason i KEEP finding 22 and 1 7 shell's near gate's by the road's :laugh:
