Working as I do with offenders,I know that everyone(without exception)has a 'Duty of Care'.And,as I see your case,as long as you are within your rights to have your dog off the lead then the landowner has a 'Duty of Care' to anyone who uses their land. That said,I would say that the case does hinge on you being able to prove that you were within your rights to have your dog off the lead. All land is owned by someone,so firstly find out exactly who owns the land(land registry office)then contact them about your case, and allow them to come back with a reply. Then you can see a solicitor, when you know what the landowners stance is.Are you a member of 'Countryside Alliance' or 'B.A.S.C.' as they have a legal department that would be happy to help you........................Best of luck with the dog and your case..................Martin.

hi, j28

sorry to hear about your dog. if you contact any solicitor mate they should be able to give you some advice over the phone. take pictures of the area in case they tidy it up in the meantime, if you get some with broken bottles etc. and it is a park where people can freely roam, then your local council is responsible for the upkeep and safety within that area... take pics of your dogs injuries. then confront the council and ask them to at least partly pay for your trouble and the dogs injuries. if your not meeting any progress contact your local member of goverment. i would not let it rest when faced with such a heafty bill at someone elses carelessness. hope all turns out ok mate. best of luck.

Have you thought about going to your local paper and see if they will do a story on it. One to bring it to the attention of others as a danger as you say it could have been kids out playing Or write to you local MP I would not sit on it there would be no harm in trying good luck

that should feck for everyone........dont blame you for trying, but all they will do is ban everything.

I was thinking the same, they will either ban dogs or they will have to be kept on a lead. They will do everything they possibly can to avoid having to fork out in the future.

MOLL.

  • 2 months later...

Just an update

After over £1500 being spent my bitch Lurcher got an infection in the main bone and was PTS on Thursday

My claim is still ongoing

I will be looking for a bunny basher who is up and doing the buisness already now(not a pup) just so i have another lurcher to work with.

Got money so willing to pay if anyone knows of a bitch / dog which is ok with other dogs/terriers

Thanks

John
