Nay 1 Posted April 2, 2012 Report Share Posted April 2, 2012 Hello, can somebody who rents the shooting rights off the land owner invite a non shotgun certificate holder to shoot. I know that if it was the land owner it would be lawful as long as it was supervised by the land owner and he was using the land owners gun. matt_hooks 188 Posted April 2, 2012 Report Share Posted April 2, 2012 (edited) According to the firearms act 1968 (amended) 11 (5) A person may, without holding a shot gun certificate, borrow a shot gun from the occupier of private premises and use it on those premises in the occupier’s presence. Now, the two issues are obvious. Who is classed as an occupier, and how "present" do they need to be? The guidance states that "anyone holding the shooting rights over the land" can be classed as an "occupier". There's no mention of "ownership" or anything like that. For the "estate condition" to be used with rifles, the wording is similar but different, but to use that defence the guidance suggests that "within sight and earshot" is sufficient. You are renting the shooting rights, and so could be classed as an "occupier". I'd suggest getting in touch with BASC rather than the firearms department. The police aren't renowned for their knowledge of the law as it pertains to firearms, nor for applying it in a fair and consistent manner. Nay 1 Posted April 3, 2012 Author Report Share Posted April 3, 2012 Thanks for your reply's, I tried ringing basc before I put the post on but they were unwilling to talk to me cause im not a member. I also tried Countryside Alliance which Iam a member of but only got through to answer phone. Me and a friend of mine are renting some land for rough shooting and just wanted to know where we stand with stuff like that. Like i say cheers for the reply's. pipcock 21 Posted April 3, 2012 Report Share Posted April 3, 2012 You may only lend a shotgun to someone without a certificate if you are with that person, on land of which you are legally the occupier OR if you are at a clay pigeon shoot where the chief constable has granted special permission to allow non-certificate holders to shoot. this is off the basc site Quote Link to post Share on other sites
