I may be wrong, but I'd guess that "dog fouling" will come under Statutory or Regulatory Law, there are also "By Laws", but be sure, there IS a law against dogs shitting in public places. You are saying that ALL UK law is subservient to Common Law, and ONLY a "Common Law Judge", (whatever that may be), is the only person who can issue a fine ??? Then can I claim back the fines I've paid in various Magistrates Courts over the years, as, according to you, they , the Magistrates, wern't allowed to issue fines ??? What about traffic fines ? The rest are statutes and regulations, created by men who are obviously better than you or I. I've never signed a contract with my council so any fine I've ever received has gone in the bin.
