As far as i know the right to roam act is about land owners opening up tracts/walks through there land for jo public to enjoy ..the right to *roam* isn't a free license for you to go anywhere ..i mean

Its quite simple anybody has A right to roam over land thats not considered to be a private garden or grounds in Scotland to gain access for for enjoyment like walking, camping, climbing etc.

 

But these rights come with responsibilities, like you cant walk across crop fields and neither can you disturb animals like sheep when lambing etc.

 

Such access may mean keeping your dog on a lead to prevent worrying stock etc and skirting perimeters of fields rather than taking a direct line across fields that contain stock etc.

If you are claiming the right to roam as your entry to private land dogs must be on a fixed non extendable lead. Plus you must have an access point where you can get in without climbing fences or pushing through hedges as both of these types of access could be seen to be potentially damageing to property.

Right to roam is bull be it a 100 acre field or 10 foot garden the thought of owning land and having tom dick on it is crazy .

Would love to see somebody face who use my land for dog trainning when I turned up with my mutts in there private garden for a traiining session and fouling there garden.

 

Still its the law but its rubbish if you ask me.

I no what you mean and not into doffing my cap to the laird etc but its hard for me to see the diffrents in legal and morale terms

Between 10000 acre hillside or mine or yours backgarden .

They just got a bigger garden than us .

In england we dont have the huge wild tracts of land like you guys have so its slighlty diffrent .

But the land we was working the other day is overrun with dog walkers a real hassle when working the ferrets as there dogs are unbroken to ferrets .

Dogs in longnets etc etc etc when you tell them to jog on they tell you feck off like some are implying that would be the case on this thread .

Its a real headache and one thats not been very clearly defined ,and the simple fact is in southern england you could not do the illegal mooching that is quite common up your way .

 

Just a strange old quirk of law the right to roam over private wild land.

on a similar note, I went lamping a couple of weeks ago and on one of the fields I have permission on some cock was jogging with his border collie with one of the head torches on, he ran the entire perimeter of the field twice.....kind of spooks the rabbits a bit that sort of thing!!! Who the hell jogs on a farmer field in the middle of the night? There's some odd folk about!

 

I'm in two minds about this right to roam thing. Seems immoral that someone can buy vast areas of the countryside and stop people from going on it, farms excluded for obvious reasons! but on the same note if your rich enough to have a lot of land why shouldn't it be private to you.....can't make my mind up on that one!

Yes indeed if I won the lottery and bought a massive scottish estate I would not want you lot lamping poaching on my land and you would have to doff you cap to me as well.

With the right to roam up in Scotland,how does that work when it comes to poaching land etc? My mates got fined down here in England for going equipped to poach because they had a lamp,battery and a sack lol. ATB Andy. :thumbs:

just because you're able to go on some land it doesn't mean you're allowed to hunt, two seperate issues. Hunting is allowed if you have permission to hunt, not just because you have permission to go on there.

Just to throw the spanner in the works if i have a piece of land that i lhave leased to me and i need access to it i can use my access right carrying a rifle unloaded over that ground that i an crossing to gain access to my legal ground without hinderance under the right of access code but cannot if the rifle is loaded, but it does not have to be covered.

Likewise people use the access rights over land to access the foreshore when wildfowling where between high and low watermark belongs to know one etc in certain circumstances where it belongs to the crown estates.

 

This only applies to laws and access rights in Scotland I should add I use my rights under the access codes regular travesing others land to get to my own.
