They can't re trial you on the same evidence but if something new crops up you can be re arrested and re charged with the offense . Happened to me over gbh served 9 months over it Edited January 26, 2012 by born to run1083
Kay 3,709
If "new and compelling" evidence is produced. they can order a re trial , so it looks like they may have got a case together for the prosecution with new evidence that wasn't presented in the original trial
springerboy 9
it really bugs me with all this crap about retrying people for a second time through this new law (what tax payers have to fund)is there no serious crimes happening now which the polis can be channeling their efforts on to charge people ie hare coursing for one lol(joke) why dont they try and catch the beasts which prey on our young and elderly every oyher day
poacher3161 1,766
Think its all to do with the new advancement in dna testing and such like and if it can secure a conviction in an horrendus crime why not.
Malt 379
Well that was my understanding of it. The lads are to be questioned again ,after being to trial and aquitted of the crime. Didn't they get found 'not proven' instead of 'not guilty?' From what I've heard they all blamed each other first time round.

I know for some people it's a good idea, but there also a dark side to this and could be used against someone by disgruntled CID who lost the case.

Paid 935
Makes sense to me that if you can use modern science to convict people who have been found not guilty in times gone, then you should use that science, and convict on it. If it is sound.

Aye when it's something worth while for a crime worth chasing, but to waste thousands on stupid retrials is silly I've been retrialed more then once for silly things, one was speeding and aparant failing to stop and another was gbh that one they got me on. So is fair enough but the first was just the coppers trying to be lying wankers. Most of them are bent and make false evidence to suit them and 99% they get away with it
