StephenWalsh 73 Posted January 21, 2012 Report Share Posted January 21, 2012 Under a road bridge there would still be enough space for non targets to activate the trap, likewise it would depend on the size of the culvert, but I would think the same would apply. To me, you have to picture the target species and what they would likely be caught in when setting a trap, either by size or particular location, and what would prevent non targets from getting into. The tunnel is there to protect from non-targets and also to make the trap work properly. There was a test case a few years ago, where the defendant unsucessfully claimed that a trap set in a loft was covered, and therefore within a tunnel. The judge threw it out as the STAO is quite clear about the need for a tunnel, and a loft does not consitute a tunnel. There is nothing to stop anyone setting a Fenn trap under water, but it must be within a tunnel. Quote Link to post

logun 91 Posted January 21, 2012 Author Report Share Posted January 21, 2012 once again the rules aint as straight forward as they can be,, if i set a body gripper under a foot of water,under a road ,bridge,, and one in a tunnel dug into bank with trap placed inch or two inside ,, what do you think would have the best chance of catching "" none targets " easy aint it ,,not hard to work out ,, time to rethink the law but done by people who knows what they talking about and the experience to pass on to others,,..
