Hunter or poacher

should be ok over here pal have poached most of my life and never had any troble of the law had a shotgun pointed at me a few times out the window of the jeep and get the f**k off my land but thats about it realy,hard men with there guns,

 

was out a few years ago lamping for rabbits with my lurcher in co. sligo and heard a shot right near me and the sound of shotgun pellets hitting the hedge right next to me...sent the hairs on me neck standing! i ran like feck and got back to the van safely! as i had no perimssion on the land i did not challange the farmer, but, reported it to the guards (irish police), they came back out with me and found out who's land it was, the bollix that shot at me had his gun taken off him and got a caution from the guard, he should of been done for attempted fecking murder the c**t!!

over here in Ireland, they make up the law as they go along!

most of the time, i have never had any problems, but their is allways the one!

some mad farmers over here can get heavy handed and shout a lot, but ususally if you go, its the end of the matter, have not heard of amyone over here getting prosecuted for trasspass in persuiet of rabbit or fox.

Good on you for going to the guards. A lot of people wouldn't have bothered. I know it annoys some farmers but catching a few rabbits (or hares) surely doesn't merit death by shotgun. Some people aren't fit to have guns.

 

Thanks. i totally agree with you, their are lads in gun clubs out their, trigger happy, like a bunch of cowboys taking the law into their own hands!

simple one really. DONT GET CAUGHT even with loads of permision the grass always seems greener the otherside of the fence

It all boils down to having permision or not and even takein rabbits on public land without permission to do so will get you prosecuted if caught as i once got fined £60 for ferreting piles of rubble

Lurcher 330 i would imagine you would have to be caught running deer or worse have 1 in your possesion to be actually done for poaching deer,BUT to put a lamp on deer at night i think is an offence.I was done for puting a lamp on a river and accused of poaching salmon even though i had not means what so ever of taking them out of the f*****g river.They done me for disturbing fish and having in my possesion a lamp for the purpose of taking fish,dont know how it would work with deer or hares for that matter.Was hunting in an area only last sunday where there were signs on the farm gates,ANY DOGS FOUND OR SEEN AMONG SHEEP WILL BE SHOT,what happens if your dog runs a fox and loses it and is making its way back through a field like this and gets shot,even though its completely stockbroken,by the way we had permission,lol.

up here the farmers are usully ok but the odd one cu b funny if he had an unwanted visit from th pikeys during the night n nicked whatever tickeled their fancy. when we were younger the fkn pellers tortured us they followed us n shone spotlights into the fields we were hunting and were shouting to scare the animals the c**ts. my belief is if the animals r wild then we have as much right to tke them as the snobs who shoot the land :victory:

That's what i was wondering fat man,can you be done for going equiped to poach deer or any else for that matter,even i your out to hunt vermin

What about walking on a public footpath at night with dog and lamp. I walk my pup at night as I work late, I'm not hunting but I have the lamp with me(Because it's better than any torch obviously) Wellys on and Lurcher off lead. The public footpaths round here go all through the fields.... I like to take her on a good run.

the following is for information poaching is not theft, nor a particular kind of theft.

poaching is the unlawful taking or killing of game & rabbits.somewhere you don't have permo

theft is the taking of property belonging to another.

wild animals which are free to roam are ownerless & connot be deemed property but they can be poached.

section30 game act 1831;an offence is committed by any person who tresspasses in the daytime by entering or being on any land in search or pursuit of game & rabbits. (tresspass is a legal mine field in its self) Search and pursuit dose not mean that actual chasing or running after game & rabbits has to be proved. the mere intention of a person looking for game while on the land would suffice.the offence is committed where there is pursuit of live game

heres one to remember:game acts 1831&1832anyone found committing the offence may be asked by an authorised person to give their full name and address and to quit the land forthwith. if a false name or address or refuse's to give name ect or willfully continues on the land or returns you may be arrested the power of arrest only applies if you are on the same land :hmm:

night poaching act 1828 : a legal pit fall for the unwary. anyone unlaw fully on land at night in search of rabbits does not commit the offence of night poaching even if you have the equipment with him (lamping equipment is deemed as instruments). the use of dogs is not an offence under this act. anyone searching at night for rabbits ect with a dog and nothing else would not commit an offence of this act untill actully taking or distroying rabbits ect.(unless on permission.)(here comes tresspass agian)

the hunting with dogs act has come into this as well. the game licence being done away with in 2007 if this is wrong in anyway please let me know as i said just a guide. full laws on country sports is a nightmare :icon_eek:

I was always led to believe that poaching came under the theft act as that wat it said on a record of my previouse a soliciter showed me.

i think it depends what your poaching rabbits would be wild but phesants that have been put down were paid for so do they get classed as belonging to someone so its theft?? unless they wander on to someone elses land other than the person who purchased them, would they then be deemed to be wild? confusing :blink:

Burto , so what your saying its not poaching if its night and you havent caught any rabbits just tresspass ?

not sure if this right but tresspass comes into it and then search and pursuit one throws back to the other it gets confusing Edited by burto
