flushing hare into a gate net..is it legal

1) yes as long as you own or have the landowners permision

2) yes as long as your using the dog/dogs (but not more than 2) for flushing and not hunting

 

this is only my interpretation of the act :thumbs:

 

i think this is correct but raises another question how many steps is flushing and when does flushing become corsing and another question if we cant answer it do the old bill know the answer

if youve got a net set then you would be flushing, the same as if your`ve got a gun. but if you have neither and you just had the dog/dogs then you would be hunting.

a good answer paulis and in theory i think you would be correct, your intentions backed up by your actions ( flushing and net or gun ) but what do you think would happen if when the quarry does a number on you takes a direction you havent acounted for and your dogs persues ,as i think most would .if this was seen a crime ( if you can call it that ) would you be done although you have taken reasonable steps showing you initial intentions i think the old bill would lift you any way

hmm tricky one. good point salukiman and what if the dog caught the hare before it hit the net.

This may be viewed as coursing by trying on the 'flushing game' loop hole.

Simply putting up a net means does not mean in the eyes of the law you are not coursing.

 

I'm not trying to get around the act. I really do want to flush hares into a gate net with my whippet

who just does not have the speed to catch a hare anyway.

 

Guess i'll be risking it. I have full permissions from the landowner to hunt rabbit by day and night and they have agreed to me trying gates nets for hares. But I don't want any tricky situations that may jeopardize this arragement.

Are you netting these hares for a purpose, i.e. tagging, relocating, etc? Or are you clearing the land for the farmer, or just taking one or two for the pot ? Unless you can count on the full backing of the landowner/farmer, I think the police would still try to do you for coursing, wether netting is legal or not.

i would like to know your intentions with netted hares as well mate would like to think you were relocating them rather than knacking them but its your permission and you do what you need to do atb billy

jonnywhippet you gave a real truthful comment about you whippet and paul nettig thems fine netted a few as they were only going to shoot them we got 26 dry stone walls and gate openings but had to get chased in and some never gott there , there a good place in durham for netting and the borders of scotland the dales etc biggar area was good hares would come of slopes and move to grass feilds useing gates ,
