We dont know the ins and outs of the circumstances in which they were caught, but if the prosecution have good concrete evidence, then they are in the shit, going to crown court, and jury trial. Personally, i would not go near a jury on badger digging charges, 99 times out of 100 you will lose, due to the stupid way the population sees the badger, and an inability to distinguish between digging and baiting.
