I think you'll find threats to kill is a very serious charge :yes:

I`m a bit worried about the police! they`re coming to see me tomorrow about an incident tonight.

I went for my evening walk with my cocker spaniel as usual going round our usual route which takes about 30 mins. We`ve been doing this for about two years and midway along this route there`s a particularly good field Tara loves to go in to chase the rabbits as it has plenty of them. After 5 minutes of getting the run around from them I call her out panting and we head on our way.

This field has two horses and two Shetland ponies, which we regularly feed carrots apples and the occasional loaf of bread too as I take the grand children round this route. The animals know us and come charging up the field when we call them. At no time ever has Tara ever chased or given the animals any cause for concern!

She is a trained working cocker spaniel and I have had far to many compliments about her behaviour to mention on this.

Anyway tonight a black 4 X 4 pulls up with 3 or 4 inside and the window goes down. The driver then proceeds to swear about Tara having being in the field and I tried to mention she was trained etc causing no harm! he was having none of it! and proceeded to rant and rave.

He then drove 20 yrds turned his motor and came back.

This time he said "If I catch her in the field again I`ll Kill it"

My reaction to this was "Kill her and I`ll Kill You! "

 

Still ranting he drove off only to turn and park up on the main road watching us.

I decided to carry on our route,which took us out of site of the 4 x 4 . when we got back onto the main road the motor and an other car were back down the track road seemingly looking for us?

This is a tenant who leases the field to pursue horsey activities, and was doing so at the top of the field when we arrived.Tara never went anywhere near them.

 

I was n`t heated up or argumentative, on reflection Tara is a part of my family and if someone threatens to kill your dog is that not the same as saying I`ll kill your son/daughter. That`s why I responded the way I did.

 

I have heard of farmers shooting dogs that have been pestering live stock etc and can understand that. The truth is I did n`t realise how much she means to us until tonight.

So its a worry the police calling round, I`ve never been in trouble before so not looking forward to being interviewed.

I fully understand farmers who have had to shoot dogs that have attacked or distressed cattle/sheep and they have my sympathy, irresponsible owners should be brought before the courts.

Any comments would be welcome.

Explain that your dog was 'under control', which is all that is required in public, unless signs stipulate other wise.

 

Explain the threatening manner the other party conducted themselves in, and how they threatened to 'kill' your pet, merely for entering the field chasing a rabbit, from which you immediatly and successsfully called her back. Maybe they even threatened you with violence?

 

And also, a farmer can ONLY shoot a dog if it has actually caused proveable harm to his stock, and he pretty much needs dead animals or witnesses.

 

I wouldn't worry mate, you will be fine :thumbs:

Under the Dogs (Protection of Livestock) Act 1953 the owner, and anyone else controlling the dog, will be guilty of an offence if it worries livestock on agricultural land. The dog must have been attacking or chasing livestock in such a way that it could reasonably be expected to cause injury or suffering or, in the case of females, abortion or the loss or diminution of their produce. The definition of 'livestock' includes cattle, sheep, goats, swine, horses and poultry.

 

Anyone who is the keeper of a dog that causes damage by killing or injuring livestock is liable for the damage caused

 

The owner of livestock is able to kill or injure a dog that is worrying or about to worry livestock. This extreme measure can only be used where there are no other means of ending or preventing the worrying, or where the dog that had done the worrying was still in the vicinity and not under control, and there were no practicable means of establishing ownership.

 

Lets just clarify this; the OP openly admits that he has been allowing his dog to chase rabbits in a field with horses in it. He also admits that he has been feeding the horses in that field with totally unsuitable food, AND when challenged about his behaviour threatened to kill the owner of the horses....

 

I think there is much more to this story than meets the eye......

Wilf - i did think that as i left the thread, but didn't have the heart to say it, and to be honest how likely is said copper (conducting the interview) to have been browsing the THL general section before work. I don't think they will call in MI5 for this.

 

R.Docks - so when is it ok in the eyes of the law to shoot a dog for merely 'trespassing' . Simple answer, it is not, and it would be a criminal offense, leading to the loss of SGS / FAC and more.

 

As for "totally unsuitable food". . . .. aye what a total b*****d, feeding a horse a carrot, HOW COULD HE???? :blink:

Even if he's the worlds leading equine nutritionist the plain fact is it's not his animal to feed he's getting all defensive because somebody "threatened" to shoot his dog yet he's actualy taken "action" (feeding bread) that could lead to the death of somebody elses beloved pet. It's a no brainer from where I'm sitting

I apologize, i missed the 'occaisional loaf of bread' bit on the end, yer that's a bit wierd.

 

Still don't think his feeding the horse had much to do with the situation.

 

From where i am sitting the situation would have been much more easily resolved if the 4x4 party had been a little less of a c**t when dealing with this fella (if he is telling the truth), manners cost nothing, and there is no need to shoot your mouth of trying to be the hardman.

Being honest, if i was walking my dog off a lead in a field and not bothering the stock, and then a bloke came up and told me to put the dog on a lead, what did i think i was playing at etc, i'd feel embarrassed, apologize and stick mutt on the lead.

 

If however someone marched up and started threatening to shoot the dog straight off and being a mouthy c**t, words to the effect of 'shoot my dog and you'll be getting fecking shot' may leave my lips as i put the dog on the lead, it's a natural response when someone acts the c**t.

Just put yourself in the position of the horse owner for a moment....

 

You spend a small fortune buying, keeping and training a horse, and suddenly it goes down with colic. You have no idea why, but get it right with the help of a vet and breath a sigh of relief.....

 

A few weeks later, you go to do your horse and find that it's pulled a tendon. More vets bills, more heartache, and you have no idea why it's happened.

 

Someone tells you that they've seen a dog running around in the field, and the owner of the dog has been feeding your horse apples, carrots and BREAD....

 

One day, you see someone letting their dog run around in the field and realise that this is likely to be the cause of several thousand pounds worth of vets bills, and a whole load of heartache.

 

You approach the dog owner, and tell them in no uncertain terms that their behaviour is not acceptable and get a load of lip back.... you then remind them that if their dog is found worrying your livestock it could be shot.....

 

Now that is just one possible scenario.

 

Put yourself into their shoes; they've been through hell, and now someone has threatened to kill them just for trying to protect their livestock.......

 

As I posted earlier; there could be more to this than the OP has posted, or knows....

Assuming the OP is telling the exact truth i think the horse owner could have been more tactful in his approach to start with.

 

Threats to kill the dog seem a bit ott,and not very sensible unless hes going to camp in the field with his horses.
