Fox/badger sett

Alright lads never done diggin for fox only rabbits so bare with me just wonder the law says it's ok to use terriers underdround to flush animal to gun but sometimes (most) it doesn't work like that and we have to dig my question is what if u send ur dog down and it's a badger sett how are we supposed to know until it's to late also if Joe public is watching you and you no you are doing nothing wrong so carry on and bang you break through and little old badge is ther Joe phones police and you are up in court how would you/police prove what quarry the target was I am a new lad learning so please keep negative comments to 1 self genuine advise only pls lads atb

Good men go by them rules and you will be trying to explain it to a judge but he wont be listening.He will be listening to the RSPCA EXPERTS.

To my knowledge the law in England is a maximum sentence of 6 months or a 5K fine. Also dog ban etc.   My advice is keep a low profile and learn all the signs of fox/badger activity intimately. And

Everyone that works terriers SHOULD know the law regarding the sport!

There is nothing to prove if you are at a badger set you are f****d.You better learn about it now. If not you will have plenty of time in jail to read up on it.

its very hard to tell in some cases when digging was legal ive dug foxes from earths and the week later found old smelly there with no dig out, bedding or nothing, was 100% dog was at old red until we broke through and im sure 90% of digging lads have done the same but most of the time ya can tell but to many of those black and whites about found 4 of my good fox earths this year been taken over by billy,i had a mate once digging at a fox earth police arrived and rspca and rspca claimed it was a badger set went to court got some experts report to say it deffinately wasnt a badger set and never has been was found not guilty so its a hard one only you can make the decision to enter ya dog :thumbs:

no expert ,but i would think you ll tell the differance by smell of hole,and size of throw back,along with localy placed shit pits ,or food out side of hole if foxes are using it.

in larger earths it is possible for the fox to lodge with the badger. (as will raccoon)

the ground sign normally shows who is home (latrines,bedding indicative of brock and a mess of bones and fur and feather showing charlie may have her cubs etc et)

experiance isthe key thing to have and you get it by making mistakes or listening and watching ( the latter two being preferable lol).

 

having hunted in a country where both quarry are legal i can say that badger will take on man made earths of as little as 20 cm width and fox will happily co inhabit earths of badger (the germans call it " castle peace" ).

 

both quarry will be foundin unlikely places (young boar badger being turfed out to mating time and taking on "unsuitable" earths/pipes/hollow trees..........).

If your caught on any sett or earth these days with a shovel and terrier ye are in court,even if your doong terrier work within the law if a member of the public phones the police and they attend with the rspca ye have a good chance of ending in court,if ye are digging here within the law and the police attend they will more or less just question ye and ask to see the landowner or shoot captain or keeper and after a chat the police will leave,but if the police yurn up with the rspca no matter how well within the law ye will end up with a tug for sure,my best advice is dont be seen not matter what ye doing its less hassle and ye can enjoy ye sport and dogs in peace :thumbs:

ur hardly gonna get loads of jail for it but there r signs to tell u wots home like bedding out side the earth an prints and kick out

well you are going to get abit of time in jail for killing a badger 6 month but for digging a badger its 3 year well thats the law in scotland anyways :thumbs:

My advice is keep a low profile and learn all the signs of fox/badger activity intimately. And if the shit hits the fan, prey to f**k you break through to a ginger face and not a stripey one!

 

Also make sure you have all your permission sorted properly and proper equipment at the dig, especially a gun as that is what the law requires these days.

 

I may be wrong here but personally I think looking professional in what you are doing gives a much better impression if the police turn up than if you look like a thug out to smash up the wildlife!
