J Darcy 5,871
So what penalty does theft of ground game come with? I thought rats and rabbits were vermin so couldn't be classified with hares and deer etc? God knows. The copper said it is the same as going into his house and takin his money. Because for all we know he could be shooting and selling the game his self. Summet like that anyways. But he also said rabbit is classed qas edible game. Ergo its classed as trespass in persuit off ground game going equipt for theft-of ground game. And if you do catch then theft of ground game. Stupid coppers like. They just told us to go home lol Hi Sandstorm, I believe rabbits are only classed as game if they are taken illegally. Legally taken rabbits could be taken by persons without a game license. JD Nothing to with game license. If its on the ground and edible apparently its game. As is hare and deer. And whatever else. All ground game. Like I said theft of ground game. Is supposedly the same as going into somebodys house and taken there property. But hey. It will never stop me. If you cant get permission how else do you get your dog some sport????? samstorm 34
They are still classed as game. Difference being its not theft as you arnt poaching them. Cheers Quote Link to post
artic 595
They are still classed as game. Difference being its not theft as you arnt poaching them. Cheers Rabbits are not classed as game. Not in the day time or at night. However: The game act 1831 does state that no one should enter upon land without consent in pursuit of game, woodcock, rabbits and snipe. The Night Poaching Act 1828 states the same, but punishment is a little more stronger, and allows gamekeepers to arrest. The deer act 1991 will punish you even more if you have killed a beast out of it's season. There are exemptions in place for this. These are all lengthy and very old acts which have been amended........slighty. Quote Link to post

But, once illegally taken ARE game (though not by name), In so much as that you will need a game license to 'poach' rabbits. (Crazy Law I know!). This is my understanding on the reason that you can be charged with poaching offences where rabbits are concerned. Quote Link to post
samstorm 34
So therefore if you poach a rabbit its theft of ground GAME. Quote Link to post
J Darcy 5,871
So therefore if you poach a rabbit its theft of ground GAME. Hi, I do not think it can be theft if the rabbits are wild and alive. This is due to 'wild' quarry not belonging to any person if it is free to travel at its own will. However, once dead the 'game' can be taken by theft as it also can if it is enclosed. This is why 'park' deer cannot be poached, their taking is classed as theft. Poaching is :the unlawfultaking or killing of game...... Theft is: the dishonest taking of property belonging to another. So, in summary it is not possible to thieve game, only poach it. This is how I understand the law to be. But I've been wrong before....... Quote Link to post

This is how I understand the law to be. But I've been wrong before....... Also,,,,,,,,,,,,, Poaching is the illegal taking of wild plants or animals contrary to local and international conservation and wildlife management laws. Violations of hunting laws and regulations are normally punishable by law and, collectively, such violations are known as poaching. It may be illegal and in violation because The game or fish is not in season; usually the breeding season is declared as the closed season when wildlife species are protected by law. The poacher does not possess a valid permit. The poacher is illegally boning the animal, animal parts or plant for a profit. The hunter used an illegal weapon for that animal. The animal or plant is on restricted land. The right to hunt this animal is claimed by somebody. The type of bait is inhumane. (e.g. food unsuitable for an animal's health) The means used are illegal (for example, baiting a field while hunting quail or other animals, using spotlights to stun or paralyze deer, or hunting from a moving vehicle, watercraft, or aircraft). The animal or plant is protected by law or that it has been listed as extinct or endangered (see for example the Endangered Species Act for the USA or the Migratory Bird Treaty Act of 1918 and similar laws/treaties. The animal or plant has been tagged by a researcher. Note that only wild animals can be poached. Stealing or killing domestic animals is considered to be theft ("cattle rustling"), not poaching.
