If you are out sick and and hand in a doctors cert I don't see how they can sack you If a doctor says you are unfit for work nobody but another doctor can say you are well enough to work they are not qualified to go against a doctors word.

Legal requirement for dismissal of an employee of more than 2 years standing is:-

One verbal warning, confirmed in writing;

Two written warnings;

Hit the road Jack.

 

All warnings must be for the same offence. They are well out of order. Nail 'em to the wall.

They cannot sack you for being sick if that is their reason they have to

 

a. prove your lying or misinforming them about being ill.

 

or

 

b. If they are saying you are unfit for work on a permanent basis then you would have to see an independent doctor for a medical assessment the outcome of which would explain your abilities.

 

If you have provided a reason for each day you have had off then see option a. if they are saying you are too ill to work then see option b. :thumbs:

I worked as a 'Community Punishment Supervisor'(don't hold it against me) I had been there almost 10 years,and they do have a policy but have totally disregarded it.Wilf,it is Government run,so not a small affair.
